Rec' letter today from Barclaycard along with the past statments for two years, up to 2007. With a letter stating that the rest of my statements are held on Microfilm and would take longer (up to six weeks or so) ((their words)) to be sent to me. They said that 'The Information Commissioner' is aware of the situation.!!?? Is this, them stalling me? Should I still report them the to 'Commissioner' when their 40 days is up?
Anyone else had this?
Also.... Should I send my first letter off, claiming for the charges from the past two years (with the statements that I have) and stating I would also be claiming in the future once I have rec' the rest of my statements. Or is it best to wait till I have all statements and claim them all together???

I would suggest checking your account as I had that letter offering me the £12.00 difference, I turned it down, but when I checked my account online they had already credited my account with that money, I rang them to say I dont want it, then proceeded to leeter before action, gave them 14 days to come up with a beter offer, but today is d-day, no offer in the post, then its court.
as for the money, its a devils adovacte, as yes the difference between what they charged and £12.00 been set down, realy how far you are prepared to go, also what stunts did Barclaycard pull, one of my charges was "out of order fee of £40.00", extracting the p... thought that look good on the court forms.

Hi barclay card have refunded automatically £422 TO MY ACCOUNT although the charges are way more than that. Also another letter came today to say they have reduced my credit limit from £700 to £290. Which after them putting in refund of charges that is what is left on my account. Should i go for the whole lot. Am sooo gutted. Mind you i feel like cutting up the card and sending it back. Update, turned down there offer of £119.00, sent it with "letter before action", that they had 14 days to reply. Today was d-day, goth there letter back.
Extract the best bits...
"I note that you are disaatisfied with our offer to refund £119.00. however our poosition remains that we believe it is fair when customers break the terms of their agreement with us, we redcover the costs. Therefore I am not prepared to consider your request for further refund.
So here goes, as just about to go through the money claim website and start court proceedings, any help or advice from anybody who has been through this with Barclaycard, would be very much appriciated.

Well, after much prevaricating from Barclaycard (sent request on 24th Jan, signed for 25th, Barclaycard claimed they never recieved it till the 7th, well who signed for it then!!!) I finally recieved my statements only to find that the last two years are my brothers statements!! I have tried to speak to them on the phone but they dont have a clue what they are doing and want to charge me 3quid per statement and do not seem too worried about the obvious security breach in sending me my brothers statements! They told me I had to write a letter and eventually after telling them they had broken the law twice, once for taking too long and second for sending my brothers statements, he said that someone from the customer complaints will ring me back.
I have already complained to them to the information commission (on thursday, still no reply) but is there anything else I should do?

HI thanks for that, I have not actually accepted the refund as such yet, They automatically put it back in my account. I will be writing a letter to them saying thank you for partial payment but i want the lot. Then am going to pay the balannce on the card and close the account. Have got a cashplus card so do not need the barclaycard. That will then be another debt paid off. Thought i needed the card. But i dont really. I got home at lucnhtime today to discover a letter from Barclaycard agreeing to pay the full amount that I'd requested into my Barclaycard account in full and final settlement of my claim.

My outstanding balance with them is being paid back to a DCA - but as they have given me 8 weeks to reply I like the thought of the shock tactic of writing thanks but no thanks - and seeing what they do from here.
Also I need to write to Littlewoods Visa who set their cards up through Barclays - the only address I have is a PO Box one - so question is should I write to Barclays direct or to Barclaycard?0 -
Just had a phone call from Barclaycard and they offered me the full amount £120 without interest as a final settlement of my claim. I gladly accepted this as I don't think it's a good idea to be greedy and carry on pushing for the interest even though I originally requested for it. They said they will put this straight into my bank account since I'm no longer a customer with them and they will send out a letter to confirm the conversation.
It only took two letters to get them to do this as they first offer me the usual difference between the charges and £12 but I said will only accept this as a partial payment and I intend to claim the remaining through court.
I just need to becareful and get this confirmed on writing and hope they don't use this to stall me. The other thing is that I forgot to ask how long it will take for the deposit to reach my bank account...

I sent the first letter to Barclaycard on the 25th Jan 07, I have yet to receive the statements, what do I do next?
I also sent the first letter to Abbey and they have started to send statements one by one, is this right?
