I sent a letter to Barclaycard on the 6th of March asking for my statments to be sent to me, this morning I recieved the following letter.....
Dear XXXXX
Further to your request for copies of your credit card statements we are writing to you to let you know about two things; firstly to enclose part of the information you have requested and secondly to explain the position with regard to the other statements you asked for.
Enclosed you will find copies of your credit card statements from June 2004 to the present time. These statements are stored on computer. We will be sending your statements prior to this date later. These later statements are stored on microfilm rather than computer and, take more time to search and reproduce. We will get this information to you as soon as we can. This is likely to be within the next 6 weeks or so.
Statement requests are being processes in the order in which they have been received to seek to ensure fairness. The data protection regulator, the information commissioner, has been made aware of the position and knows that we are writing to you in these terms. The information commissioner is also aware that whilst endeavouring to supply this information as quickly as we can we do not consider that the microfilm statements fall within the scope of the data protection act 1998. Nevertheless we are happy to provide these as a gesture of goodwill.
This information is complete in relation to your account at the time this information was drawn to it.
I have read through numerous threads on this sita and can see that the claim that microfilm isnt covered by the DPA is not accurate, and even though they say I should be sent the rest of the information I asked for within 6 weeks at the outside it will be 52 days, well outside the 40 as set out in the DPA.
Would it be worth sending a letter to them saying that I expect to have the rest of the information within the original 40 days or should I sit tight and wait?

I've had the same problem with Barclaycard as you (as have many, many others), although they haven't even bothered to send me the information from post 2004!!
My request is now outside the 40 day limit and I have sent a complaint to the Information Commisioner. I sent a reminder letter to Barclaycard about 4-5 days before the due date and when I received nothing immediately sent of my IC complaint.
I would suggest you do the same if they continue to mess you about.

I agree. They've got a couple of more days to reply to me or I'm going straight to the IC - no messing0 -
Many thanks for the quick suggestion and for the letter. That is what I was thinking about doing to be honest, I was just a little mindfull of the posibility of Barclaycard dragging their heels longer than they should or more pointedly thinking that I could be marked as a relative pushover when it comes to the business end of claiming.

I had a hell of a time getting my statements from Barclaycard,I originally went through the Information Commissioner, though eventually barclaycard did send me the statements without any help, but going through my emails,I found another area of financial institutes that I complained to ( got a feeling they were the Office Fair Trading)
The helpline number is on there, so def recommend trying them as well as the Information comminiser

I'm at the court stage of claiming charges from Barclays BANK
Today I got a letter from Barclaycard telling me they had reduced my credit limit and had removed my right to withdraw cash. None of these things bother me as I hardly use the card, I'm not over my limit and I never withdraw cash. If I can ever pay the ballance off they can reduce my limit to ZERO for all I care.
What I'm wondering though is - is this in some way connected to my action against the bank, Is it a form of retaliation.0 -

I too mysteriously had my credit limit reduced, but it was shortly after my DPA request.
Like you I don't use the card (extortionate interest rates) and also my balance is at zero - so I couldn't really care less!!
Once I've had my charges back the account will swiftly be closed!

Think its dirty tricks by Barclaycard, after I pushed for the information and got Information commissioner involved, they tpp reduced the withdraw cash off my card, but with a £400.00 credit limit! says it all.xx rip dad... we had our ups and downs but we’re always be family xx0

Hi all, here's the reply I received from Barclaycard re my request of charges and I used Martin's template letter.
Data Protection Act 1998 - Subject Access Request
Further to your request for personal data held by Barclaycard, we are unable to trace any information relating to a Barclaycard account in your name,with the details you have supplied.
If the account has been closed it is possible that the information has been deleted from our systems and therefore will not be available.
If you have any more information that you can supply to help us locate your account (e.g. previous addresses, change of name or any other account numbers held) please send this for the attention of the Data Protection Team at the above address.
If we do not hear from you within 14 days from the date of this letter we will close your request

Okay I sent them the account number and my change of name details. The account was only closed about a year and a half ago.
They dated the letter 1st March, I received it on friday 16th March so hey I guess I'm already out of time - clever eh?
They also sent me back my postal order.
Not sure what to do next, do I carry on to the court stage, reply to them, I have no further info to give, or await deadline of 40 days and complain to information commisioner?
