    Okay I sent them the account number and my change of name details. The account was only closed about a year and a half ago.

    They dated the letter 1st March, I received it on friday 16th March so hey I guess I'm already out of time - clever eh?

    They also sent me back my postal order.

    Not sure what to do next, do I carry on to the court stage, reply to them, I have no further info to give, or await deadline of 40 days and complain to information commisioner?

    Thought they had to keep records for so many years regardless of whether the account has been closed - the same as any other business? :confused:

    Anyway, I got this same letter from Natwest so I looked at my credit report and gave the dates the account was opened and closed, all of my previous addresses and my date of birth. Still waiting to hear from them but other banks have managed to find my details from this information :rolleyes:

    Hi thanks for that, it was my understanding that they only needed the account number and my name which I provided.

    Trouble is now, according to the letter, I'm out of time but the little beggers dated the letter as the first and the date I received it was over 14 days later anyway.

    I honestly reckon its a delay tactic or to stop me in my tracks. Again, though, I need advice on where to proceed with this?

    You will need to provide them with as many details as you can so I would suggest writing to them again. You could explain in your leter that you have already been in contact with them and therefore only give the 14 days to reply :confused:

    My story in as brief as poss, so bear with me.

    I sent my first letter to Barclaycard 2nd Feb 2007 (so the 40 day limit is now up) & here was their reply ...

    DATA PROTECTION ACT 1998 - SAR

    "Further to your request for copies of your credit card statements, we are writing to let you know about 2 things; 1st to enclose part of the information you have requested and 2nd; to explain the position with regard to the other statements you asked for.

    Enclosed you will find copies of your credit card statements from May 2004 to the present time. These statements are stored on comnputer. We will be sending your statements prior to this date later. These statements are stored on microfilm (rather than computer) and take more time to search and reproduce. We will get this information to you as soon as we can. This is likely to be within the next 6 weeks or so.

    Statements requests are being processed in the order in which they have been received to seek to ensure fairness. The Data Protection regulator, the Information Commissioner, has been made aware of the position and knows that we are writing to you in these terms. The Information Commissioner is also aware that whilst we are endeavouring to supply this information as quickly as we can, we do not consider that the microfilm statements fall within the scope of the Data Protection Act 1998. Nevertheless, we are happy to provide these as a gesture of goodwill."

    I have waited long enough for this info and now they are dragging their heels further! ... Any advise what to do next please???

    sorry couldnt work out how topaste the bit i needed.
    Glad theres somebody else on the great barclaycard hunt, I started August year, still not sorted.

    What Iwould suggest is, you only have there work for it, according to the DPA, they have to supply the information within 40 days, as without the info you cant proceed any further.
    I would put it in writing that you made your request on xx/xx/xx ( if you have proof on when they recieved it) add that date as well,tell them they have 40 days.

    i would also contact the Financial Obsumbmen,the Information comminnisor ( excuse the spelling), that way you will have peace of mind.

    I have recieved a letter from them today saying that they will refund the difference between the amount I was charged and the £12 guidline by the OFT - I only sent the letter on Friday so was surprised to get a reply so quickly.

    Questions is - do I accept or try and press for the full amount minus interest? They have given me 8 weeks in which to reply to them with my answer but I'm not sure what to do. It would mean that I would owe them £575 instead of £875 - a good drop I know - but they are hiding behind a request by the OFT rather than law - so should I let them or not?

    Talk about being thrown so early on - what am I going to be like when the others come through!! :p

    Standard letter from Barclaycard, just send them off the next letter saying thanks but no thanks and I'll be proceeding to court for the full amount.
  • so far i sent 'nice' letter one to b/card requesting £12 in charges back.

    they replied saying 'we are investigating'

    they replied a few days after that saying as a gesture of goodwill we will give you £48 back into your account(which is closed and in my DMP eek)

    i wrote back today accepting the £48 and giving them 7 days to refund the remainder of the money to me by personal cheque or i will go to court.

    has anyone had a full refund from barclaycard before they actually have had to file the court claim?
  • i have a DMP with CCCS and am currently going for Egg- £60, Barclaycard £120 and BArclays £750

    so far with EGG have hhad the 'we are looking into it' - well im not waiting and have wrote giving them 7 days or i will file in court

    Barclaycard offered me £48 i have today wrote back to say i accept it as partial payment but you have 7 days to refund the rest or its off to court. they also mention that the £48 will show on my march statement but this account is closed and in my DMP.

    Had my review with CCCS yesterday and asked them about it and she w asnt too clear- she directed me to this site! doh! she said she didnt think it would impact on my DMP thhough

    barclays - sent 2 letters- recieved a 'we will look into it but may take up to 8 weeks - HOW CAN IT TAKE 8 WEEKS! it took you 8 SECONDS to swipe my dough in the first place. filed m y claim in court today - am c****ing myself though!

    ii guess i wont know the impact on my dmp until im through all this but hopefully by then i will have the charges and may be able to go for a full and final settlement, although im also prepared for them being arsey about that!
