    Hi.
There pu,,ing a fast one, as long as you have never asked for statements, merely information, you do not require statements, and if you do not recieve the information within 7 days you will contact the financial obsumbmen and report them to the Office fair trading.
Barclaycard tried to pull that stunt on me, but bavked down in the end.

    Good luck

    H
PS. My claim is not going through the courts 11th April is D-Day

  • Hi There

I've recently received the letter back from Barclaycard offering the difference between the £12 and the original fee - a sum total of £271.

However, I actually demanded the whole lot with interest.

Now, I intend to send a letter back refusing this, but stating that I would be willing to drop the interest claim, and simply have the original amount (around £600 without interest).

However, I don't have the account anymore, and they explained I would have to contact them and give them bank details so they could pay the money into a suitable account.

Would I have to accept their offer citing it as partial?

In addition, there isn't a specifically worded template on the site regarding this, so if anyone has any advice as to what template to use and alter slightly, I'd be most grateful!

    Regards

    hi there
I am in exactly the same position - have replied by recorded delivery accepting amount as partial and without prejudice. I have stated I intend to claim remainder by court proceedings if I do not here from them within 14 days (used LBA template and adjusted it to suit). Also put PS on letter : as per their request I supply my bank details for their information.
I attached separate sheet with bank name sort code and account no.
Hoping the will pay direct into the account with at least the partial amount and I'll wait and see what happens with the remainder.
  • Thanks for the advice, cloth.

"used LBA template and adjusted it to suit"

Whereabouts can this be found, or am I being totally stupid and missing the abbreviation?

Either way - best of luck with your claim, and hope it all turns out good for you. Keep us posted.

    Hi Everyone,

I'm possibly one of the lucky one's and actually kept all of my credit card statements going back to about 1998.

I'm thinking about putting a claim into Barclaycard for £758 plus interest.

The only thing I'm a bit worried about is Barclaycard closing my account if I claim. I am over my limit of £1100 by about £250. Can they close my account if I claim and demand full repayment, or are they not allowed to do this?

All answers will be greatly appreciated.

    Thank all.

I sent out the initial template letter to Barclaycard just over a week ago (excluding the letter requesting statements as I have all my statements), claiming for £380 in charges. I have not yet heard from them by letter, but I checked my account online today and saw that I have been refunded £152 - which is the difference between the £20 and £12 charge. I am considering going further and claming the whole lot back - or telling them I would accept 75%. What do you think?
    Barclaycard - starting £380 reclaim (letter 2 - 20/3/07)
    - so far been refunded £152
    Capital One - started £200 reclaim (letter 2 - 20/3/07)
    - so far been refunded £80
Barclays - thinking about reclaiming £500
  • I have recently tried to claim £452 from Barclaycard regarding credit card charges over the past 6 years. I recently received a refund of £152. Can I still reclaim the outstanding amount or do I just have to settle for the amount already paid to me??
    Please help...

I was considering doing the same, but I think I'll just go for the charges minus the interest I originally asked for.

It's difficult to know what to do, especially with this OFT report fast-approaching...

Still, I think I'll follow Cloth Ear's example and push for the whole amount and see what they come back with to be honest.
  • Hi All. Has anyone had this happen to them and what was the outcome?

I have today received bank statements from Barclaycard but only back to 2004, a letter accompanied them saying that the years previous were on micro film and would take up to 6weeks.

Also received a years supply from Natwest for 2001 - 2002 but no letter or any explanation as the account is still open.
