On the microfiche thing.... i had a letter from barclaycard with full statements saying they didnt agrree with the info commissioner re microfiche, however are agreeing to provide the info anyway?! I think the reason past statements take so long to come through is because the retrieval process is longer compared to just pressing print on a computer. Also the large volume of requests means they are struggling. Serves them right for trying to dodge the DPA. rap their knuckles. Essentially if info is archived in any form, and a valid request for that info is made, then the info must be given.
Interestingly, if you switch bank accounts and ask for all direct debits etc to be switched and for your new bank to do this, the old bank MUST respond within 3 days!! If they can do it that quick for each other then why not for US !!!Sorry but please keep your signature to 4 lines in length - MSE Forum Team 20 -

I sent the letter below to Barclaycard almost 2 weeks ago and have had a reply saying that they do not understand the nature of my queery. I`m sorry but is the below letter not understandable???
Should I now just sod it and proceed with the courts or send another letter back which would delay it again???
Also I rang them and they would not let me expalin what my letter meant and that they have to have it in writing.... which of course I have done grrrr!!

With reference to your letter dated 20/03/07 and your reference above.
I will accept £120 as a partial payment only, I would like you to pay me the full amount of £367.99. I will however be willing to lower my asking price and would settle for £300, which was the sum before interest was added, if you would be willing to meet me there.
If your answer is no then I will instruct the court through Moneyclaim.com and take this case further. This would surely incur you court costs which I feel would not be nessessary if we can come to this agreement.
I look forward for a full response to this letter within 14 days.

I have so far been given the difference between £20 and £12 after my first letter, I was suprised at how quick I got it (I got the same partial refund from Barclaycard in fact). I claimed £200 and have been refunded £80. I am probably going to write back and ask for 75% of my original claim; there other option is to be taken to court, pay the full amount plus interest and charges. Hopefully they will pay the 75%Barclaycard - starting £380 reclaim (letter 2 - 20/3/07)

I got my statements from Capital One quite quickly, and they didn't charge me for them. I rang them to request a refund of my charges, but was declined. I spoke to someone in a Call Centre in India, and he was very helpful and polite, and could only suggest I write in to request the refund.
I'm only claiming around £240 - which will be a lot less if they only pay the difference between £20 and £12, but every little helps. I think I'll press for the total amount and threaten court - can't see they'd want the hassle of court for such a small amount of money.

Just had the enclosed letter - not entirely sure whether to go ahead and file a court notice or what. A bit of a pain, really, as Barclays paid up.
The original claim was for £715. They offered me £271.00.
Here's the letter following on from the LBA I sent them last Friday.
Dear Sir
I refer to your letter dated 28th March.
I note that you are dissatisfied with our offer to refund £271.99 however our position remains that we believe it is fair when customers break the terms of their agreement with us, we recover the costs. Therefore, I am not prepared to consider your request for any further refund.
As previously advide, when Barclaycard account was openend you signed and agreed to our T+Cs and this included details of our charges. The info provided at application stage clearly explains our obligations to our customers and their obligations to us.
I appreciate that this is not the outcome that you expected, however I trust that the information I have provided has clarified Barclaycard's position.
Should you have any further questions regarding this matter do not hesitate to contact me. If my reply does not meet with your expectations you may ultimately be eligible to refer to the Financial Ombudsman Service. Details of this service are available on request. If I have not heard from you within 8 weeks from the date of htis letter, I will close my complaint file in accordance with our normal practice....

That's a big difference between your claim and their offer.
Personally I'd be taking them to court. And judging by the defence they use (as published in this thread) you'd stand a very good chance of getting the whole lot!!

No you're not being thick!! There is a PO Box address for Barclaycard in the help thread, however.....

Barclaycard is just the credit card trading division of Barclays Bank.
