I sent a letter for my partner to B-CARD on 24/03/07 claiming back £150 plus interest of £55.76 and we have recieved a letter back to day saying
they are prepared to offer the difference between the charge that you have incurred and the £12.00 fee recommended. Has the oft stated this is the case now? i thought it was "put on hold".
is this right?

The original claim was for £715. They offered me £271.00.
Here's the letter following on from the LBA I sent them last Friday.
Dear Sir
I refer to your letter dated 28th March.
I note that you are dissatisfied with our offer to refund £271.99 however our position remains that we believe it is fair when customers break the terms of their agreement with us, we recover the costs. Therefore, I am not prepared to consider your request for any further refund.
As previously advide, when Barclaycard account was openend you signed and agreed to our T+Cs and this included details of our charges. The info provided at application stage clearly explains our obligations to our customers and their obligations to us.
I appreciate that this is not the outcome that you expected, however I trust that the information I have provided has clarified Barclaycard's position.
Should you have any further questions regarding this matter do not hesitate to contact me. If my reply does not meet with your expectations you may ultimately be eligible to refer to the Financial Ombudsman Service. Details of this service are available on request. If I have not heard from you within 8 weeks from the date of htis letter, I will close my complaint file in accordance with our normal practice....

if its any help its a standard reply from Barclaycard, there not prepared to up the offer at the moment, you really have 2 options, either accept the money or proceed to court, at the moment your in the strongest position, if you did see it to court, then Barclaycard would have to prove how much it actually costs to process a letter. Im going down the court action.

Barclaycard seem to be playing hard ball it has taken the 40 days +10 and even with a 2nd letter being sent they have still failed to contact me. Given that it is Easter I'm going to give them until the end of next week before I lodge my complaint for non compliance.0

I recieved a letter from barclaycard a week after sending 1st letter, in my 1st letter i asked for £500 in fees/charges and made a point of saying this amount was just for statements i had, and there's other charges which i would claim at a later date...
letter i got back offerd me £250 as a goodwill payment...
SO what i need to know is, are goodwill gesters the same as offers/final offers and if i accept the goodwill money, can i still claim for unknown fees/charges which i havent got statments for yet like i said in my 1st letter..
I have a feeling the total fees they owe me is more like £700 not the £500 i had statementsfor.

Do I have to send them a letter explaining I'm taking them to court, or just issue a notice with Moneyclaim.org?

Fom my understanding that when they offer a sum of money as a goodwill gesture, by accepting the money, it can effectively close the complaint, you could write and say Im accepting the £250, and am going to court for the rest, thou your not on as solid groud for a court hearing.
I notice you say from the statements you have got, but theres missing statements, ideally its better to claim in one go, as by putting in the 1st claim, and if you settled for there goodwill they may have put it in the letter as final settlement, which means you couldnt go back.
If you dont take any money, then your in a stronger position, also check your credit card statement, as barclaycard have a habit of just crediting the money, its a bit of a mine field, but balance out the money, the way I look at it, is 12 months ago there was no way of getting the money back, so it was effectively gone, is £250 worth accepting, or wait and get all charges and take it from there.

Good luck that is it the big decision, to be honest I took goodwill gestures with my other 2 cards, but barclaycard have been a pain, so am going for the full loy, £335 + interest.
As long as you sent them the letter before action, then that covers the fact that you are willing to start a court claim. It cost me £50, to issue my claim, I know the maximum that they can charge at moneyclaim is £120, if you were successful then the court fees would go on to Barclaycards bill,

I sent the letter saying that I'd accept their partial offer, but was going to proceed through the courts unless they offered me final payment...
Not sure whether to simply proceed with the court route, or send another letter specifying 7 days.0 -

How long has it been since they received your 'partial offer' letter?
Make sure you have given them a reasonable amount of time to respond.
If they've had, say, 10-14 days since receiving your letter then go ahead and file your claim with the court with no further correspondence.
