    Just received my statement from Barclaycard and a credit of £64 has been applied to my account on 2nd April. They havent contacted me with regards to this and I have already posted the second letter a couple of days ago threatening court action.

    Shall I write to them again now saying I accept as part payment. I only have a balance of £71.37 left and they now only owe me £96 so I would be happy if they just cleared that to be honest. Do you think they would deal with it by phone if I ring them?

    You could phone them but I would be wary of this as you cannot prove what they have said over the phone

    Just by way of update....

    I got a call from a manager at 9pm last night, very nice she was too, said the departments she needed to contact had closed and she'd get back to me tonight. She's just called and said the following:

    1) She's refunded the £10 DPA charge to my account :rotfl:
    2) I should have received statements since June 04 - they are kept where she works and she is contacting someone to find out why they haven't been sent as this should have happened
    3) Statements beyond June 04 are held at another office and due to the backlog it may take another 6 weeks to get to me (apparently there are people who wrote in in January who are still waiting)
    4) There were no notes from my 25 March conversation to say that the agent would pass it to the complaints team - she's going to listen to the tape of the call and deal with that.

    She's said she'll keep me updated, and as she does that, so I will do with you.

    Hi.
    The great barclaycard saga, I started court action, yesterday was day 14, and barclaycard replied at the last possible moment, so looks like they want to argue the case, Im asking for £335 plus interest and costs, just have to wait and c what happens.
    Anybody else who could throw up and help or advice, would be greatly appriciated.

    Since I have posted heard nothing else from Barclays and 40 days is now up 12/04.
    Natwest have sent me all of theirs and I am about to put my claims in.

    I have sent for statements from Bank of Scotland, A+L, Citicards, Lloyds, Mbna + First Direct but have heard from none of these and their 40 days are up as well (thought I'd do it all at once whilst I had the confidence). Can anyone tell me the next best action to take. Please don't tell me to phone as I haven't the 'bottle'.

    You could try sending the following letter and if they still don't reply, report them to the IC.

    ACCOUNT NUMBER XXXXXXXX

    I sent a letter and £10 cheque on the [insert date of first request] requesting six years of bank statements as is my right under the Data Protection Act. I have been expecting copies of my statements within the 40 days stipulated under the D.P.A. As yet I have not received any correspondence from you.
    By not supplying the information I requested, you have breached my rights under the D.P.A. You leave me with no alternative that if I do not receive copies of my bank statements within the next seven days, I will forward copies of my requests to the Information Commissioner.

    I look forward to your timely response.

    Find enclosed a copy of my original letter.

    I am a uni student and stupidly i got a barclaycard in my first year of my degree, but i didnt recieve any mail about repayment etc cos it was issued to my halls address (which i know i shouldnt have ignored but been stressed with my degree it jus went to the back of my mind) The limit for my barclaycard was 300 which i spent when i first got the card but i have jus recieved a letter from a debt recovery agency who say the debt now stands at 744 and they are demanding payment, i offered to pay 10 a month, which i can jus about afford but they tried to say it wasnt enough and i should, i quote, "ask my mother, father or boyfriend for help with the payment" My mum is a single parent on income support, i dont know my father and i dont have a boyfriend! They also demanded i pay by direct debit and that they need some sort of bank details, when i suggested paying at the post office or by cheque they said they dont accept.

    My questions really are can i get the interest taken off this so i pay only the 300pound i spent?

    Is it right to only accept payment through direct debit?

    Is there anyway of sorting this out quickly cos i cant take this stress! Im trying to focus on my degree i know i shouldnt have spent the money in the first place but it kept me in uni at the time so seemed like a good idea. I have struggled with money right through my degree but i havent taken on anymore credit cards this was silly of me i know but now i just want to get it sorted.

    All advise is welcomed

    I got a similar response from Barclaycard, saying that they would only refund the difference between my charges and £12. I said I'd take the amount partial payment and would still want the rest. They resfused to up their offer, so I filed a claim on MCOL. Now I'm a bit worried that I've done it wrong though, 'cos I filed for the full amount, when actually should I have filed for the balance which was left after their 'goodwill gesture' has been deducted? I'm worried I've messed up by asking for more than I'm now owed?

  • A month ago I sent a letter with £10 cheque to Barclaycard by recorded delivery requesting my charges, assuming it wasn't delivered (no info on tracker) I went onto cancel the cheque and sent them another letter (£10 cheque) yesterday.

    Today I have checked my bank account and have realised they requested the £10, but this hasn’t cleared because I cancelled it. I haven't received a letter from barclaycard yet.

    Will this affect my claims?
