  • I have just finished typing up my letter to Barclaycard requesting the list of charges owed… Gonna post it recorded delivery on the way home from work this evening…

    I have got to the stage with Barclaycard where they say they want to go to court. I've received papars to that effect, but I'm unsure what I should do next. The first sentence in their defence is " Barcalycard is a trading division of Barclays Bank PLC and not a legal entity in its own right." What does this mean? They are disputing all of the claim (about £600 inc. interest). Can anyone advise me as to what my next step should be?:confused:

    Assuming you have started court proceedings you need to wait and see if you get an Allocation Questionnaire to fill in from the courts and you'll find the guide to that in the Reclaim Help Thread which is linked in my signature.

  • Hi, could some1 please help, i have had my S.A.R. back, but only since dec 2004, Barclaycard are saying that the earlier charges are on microfilm and not computer.??? They are saying that i can receive the rest but it will take another 6 weeks or more. T hey also say that the data protection regulator, the information commissioner is fully aware of this. A m i being conned by delay tactics because i have heard that in the next few weeks the banks only have to repay the difference between what they first charged and their new revised figure.

    As you may read on the previous page, they did exactly the same thing to me and to others from the looks of it - seems like Barclaycard is one of the worst to deal with on the whole charges reclaiming story, this looks more like a tactic to confuse customers than anything else.

    Anyway, I did begin court proceedings asking for the difference between the amount of money I asked and what they gave me back.. They have to respond by 4 May, and no news yet. But what I do find interesting is that today I received a letter from them where they are reducing my credit limit -not a lot, it used to be £690 and they reduced it to £650, but still it seems more than a coincidence, since they've never done this before

  • I am curently trying to claim back charges for my sister in law from Barclaycard an amount of £473. She has recieved a letter saying the charges were "fair and Transparent" but as a goodwill gesture have paid into her account a figure of £114 the difference between £24 and £12 they curently charge. They have paid this amount into her account already with no consultation as to wether it was acceptable or not. What do I do now? I intented to write them another letter saying she is going to court for the rest of the money she is owed but I don't know if I can do this for her. She has some learning difficulties and should never have been allowed to open the account in the first place.

    barclaycard have paid me a 3rd into my account off the back of the first template letter, i have noticed this online, but as yet no letter of confirmation from them.

    does anyone have a template, i accept this only as a partial payment , give me the rest or i am taking you to court, letter?

    I wrote to Barclaycard recently requesting my statements for the last six years, but could not provide an account no' as it was a long closed account (autumn 2001 > Spring 2004). They wrote back saying they had no record of the account. I swear blind it existed. I remember having the card in my wallet!

    Is this a stalling tactic? I followed it up this evening with a lengthy conversation, but they did seem genuine when they said that they could find absolutely no record of it. They asked whether it was "issued by another company, such as Monument?" I do vaguely recall having a Monument card also. I now believe it was issued as a Monument Card and at some point replaced with a Barclaycard. Does anyone else recall this happening? Monument was owned by Barclaycard, I believe.

    I am going through the arduous process of claiming £650 back from Barclaycard. I am up to the stage where I have threatened to take them to court , and they have offered me £180 . Obviously I would like the full amount back, and I started to file my cliam on the Moneyclaim website.

    Due to the amount I am claiming for the cost for the claim was £80. I am now wondering whether I should go through with this - I have looked at a number of cases with Barclaycard on the Consumer action groups website and it seems in many cases Barclaycard are putting in a defence and it is going to a hearing.

    I understand I can claim back the £80 if I win, but I dont understand if it does go to court- will I have to hire a solicitor etc? Sorry if this sounds igonorant, but most cases I have read about in the past never made it to court, I dont want to back down but I am worried about getting into more debt when I could just take the £180.

    Please can anyone who has been in this position give me some advice ?
