    Just posting a query regarding partial payments by barclaycard. They have given me £307 back from a claim of £775. Without me accepting this, they have credited my account...which they seem to be doing to everyone! They are crafty, as they know this makes the process even trickier! But Im stubborn, and I want the rest of money! I'm going to pop a letter in the post saying thanks and I accept this as a partial offer and giving them a further 7 days to give me the rest (which I know they wont!) and then Im filing mcol. However, Im a bit worried about the mcol application and would appreciate some advise. Im not sure how to phrase my statement, as I cant seem to fit in the acceptance of partial payment into it, I always go over the character limit. And, as Im claiming interest aswell Ive managed to confuse myself! I dont understand how I can claim interest on money theyve already given me back, if that makes sense? I.e Im claiming £775 with interest which takes it to £936, do i simply deduct £307 from this? I dont get how that can be right, as I updated my interest calculations including the £307, even though theyve already given it me back. Im in a muddle!!!

    I`m slightly ahead of you on this, BC offered me £120 of £350 and I wrote back to them saying that I only accept as partial payment and would instruct the court if they did not pay up in full. BC wrote back to me saying they did not understand the nature of my enquiry, so after 6 letters to BC and all the delay tactics I instructed the court for the full amount plus interest. BC paid me £120 and I wrote an email to the court saying that they had done this and I did not actually accept this etc, the court wrote back to me saying that they did not need to know they had paid some money they only need to know if BC had paid up in full.

    I'm just wondering - "the Info Commissioner is aware of this" does not mean that he has said it is ok!

    Does anyone know whether I should report them for a breach of the DPA or is this a genuine get out clause for them?

  • I too recieved the same letter yesterday and surprise surprise most of my charges are prior to june 2004 !

    Someone's legal perspective would be great before i send my third letter to them !

    I have been looking at this site for months and months now and never realised there was a post just for Barclaycard. guess that goes to show how bad they are (being naive I never realised!!!)

    I too sent my letter to them asking for confirmation of the charges to my account, by recorded delivery, on 18th April and just checking the royal mail tracking link - my letter is not signed for (after reading all of the other messages I am not surprised)!!!

    As I sent my letter to b'card at the same time as sending letters to other credit card providers (and they have all signed for their letters) I will only assume that they received my letter the day following (19th) so will use the 40 day limit from there.

    I know we should never assume but in cases like this, I guess we have to!

    Just about to send my first request for bank charges this morning, who do I make the cheque payable to? barclays? or barclaycard?.

    Any help appreciated.

    barclaycard pulled that stunt on me to, £40.00 out of order fee, there just being a pain in the rear.
    They think they can charge what and when they like.

    Hi Charlotte.

    If its any help the £40.00 "out of order fee", is just another excuse for barclaycard to claim money from us, it basically means that youve gone over your credit limit, more than once, and that were not running the account as we should.

    Good news is we can claim for that.

    the 2nd set of charges, these appear ( my toughts, I do stand to be corrected), to be to do with the moving on of your account to debt collectors. basically the companies sell off the debts to collection firms, so say you had 2k outstanding bill, then the banks etc may sell it for £1k.

    I personally would put every charge on a claim, as your initial claim was charges applied to your account, which they supplied, so therefore claim it, if it comes to court its then the onus on the court to say what you can and cant claim for.

    In an attempt to try and speed things along a little I registered a complaint with the Financial Ombudsman Service and hey presto within a week received a letter from Barclaycard saying that they are crediting over £500 to my card - which they have already done.

    Now I have no way of knowing how they have come to this figure or if it is a reasonable amount so I'm going to wait for my statements to check before I go spending the money! I suspect it is the difference between the original charge and the current £12 charge, although the letter doesn't specify this.

    Anyway, I'll keep this thread updated - good luck to everyone.

    Hi Underground.
    The money thats been credited to your account is the difference between the £12 and what ever they charged you, at a rough guess I would say that your charges would be in the region of £1,000 + interest. If you do still want your statements it would be worth chaseing it up as they may be a lot slower now theyve credited you the money.
