You do not need a solicitor for the small claims court. The process is quite simple. However if and when it gets to court, you may find it very intimidating. I guess Barclays expect a significant number of claimants will not follow through.
I have not taken a bank to court, but I have successfully claimed againt two companies. I would suggest you visit your nearest court and view what happens. PS: I did claim against Nationwide CC for costs incurred due to an error. After many calls and several letters I got some money back. I wrote to the ombudsman, copied to NW and before the Ombudsman had even replied, I got a cheque for the full ammount and an appology from Nationwide. me again... can i claim easily on a credit card? my limit is £3500 but its sitting at £4100. the debt was passed onto mercers and they are chasing me for the cash or some cash anyway. i'm just a little worried about the outcome.
because i paid in the minimum amount, then it went over with interest, since then each month they have been charging me nearly £100. does this count as unfair? or just tough s**t?
some advice would be great. i believe i have all of the statemnets from the first month onward too.

Well I sent off my initial letter to Barclaycard today but I hadn't read this whole thread first and I think I may have leaped before I looked
As I don't use cheques and have no idea where my chequebook actually is, I decided not to include the £10 fee with the initial request for charges and deleted this sentence from the template letter accordingly. The paragraph was thus worded like so:If you are unable to provide this data, I will accept a copy of my statements going back six years; I understand that statements on their own are not covered by the Data Protection Act 1998, yet I’m not requesting the statements per se, but the charges, which I’m entitled to by law.
Now, reading this thread, it appears that some people have been sent their full statements for the past six years or so and charged £3 for each one, directly to their Barclaycard account! :eek:
Looking at the wording of the paragraph in retrospect, I think I should have added something to the effect that I expected the data to be provided under the remit of the DPA and thus expected it to be provided for the maximum charge of £10.
Is there a real chance that they could just send me my statements and charge me for each one without any interim correspondence? If this were to occur, would I have any comeback?
I'm panicking a bit now and wondering what to do. Should I send a followup letter elaborating a little and explaining that I do not expect to be charged for each statement, maybe even including the £10 charge this time around?
Wondering what to do here, any and all advice greatly appreciated, cheers.0 -

Hi all,
I also am trying to reclaim charges from Barclaycard and have sent a request for statements over 4 weeks ago... Anyway, they have sent the standard letter including statements from July 04 explaining that they will send the rest within '6 weeks or so'. Now I think what ever I say to that I wouldn’t be getting statements any sooner, so I was wondering has anyone actually waited for those 6 weeks and received anything as they suggested?

I personally believe that Barclaycard should take this with no difference to any other such request as it is with reference to the Act. The fact that you have not included the payment could only result in bank delaying your request and asking for payment to be made prior to issuing the data requested.
According to Barclaycard's terms and conditions they do charge for duplicate statements, however that is not what you requested as your letter clearly states.
Hope this helps, but have to point out that it is just my personal opinion.

Ditto...Barclaycard have paid £390 into my account from a claim of £1110. Didn't even send me a letter to let me know!!
I'm guessing thats the difference between my claim and the £12 charge.
Oh well i'll use that to pay the MCOL fee0 -
