    1) She's refunded the £10 DPA charge to my account :rotfl:
    2) I should have received statements since June 04 - they are kept where she works and she is contacting someone to find out why they haven't been sent as this should have happened
    3) Statements beyond June 04 are held at another office and due to the backlog it may take another 6 weeks to get to me (apparently there are people who wrote in in January who are still waiting)
    4) There were no notes from my 25 March conversation to say that the agent would pass it to the complaints team - she's going to listen to the tape of the call and deal with that.

    She's said she'll keep me updated, and as she does that, so I will do with you.

    Just got home to find ALL my statements have arrived - although they have made a snotty comment about microfilm not being covered by the DPA (they have sent them as a gesture of goodwill, and the ICO is looking at making changes to ensure microfilms are covered)

    Only took 70 days from sending my request letter!

    Hello.
    I sent my requests for statemements from Barclaycard (and all the rest!) by recorded mail on 26/03/07. All the others have been received and signed for except two, both for Barclaycards. Is this another delaying tactic?

    Well the saga of Barclaycard continues....

    I wrote for my statements on January 30th, got a letter about a month later saying they would get my information to me within the 40 day legal limit -- then NOTHING!!! I've had no communication from them since their one and only letter, despite three letters from me and a complaint to the Information Commissioner.

    They really just don't seem to care and flout the law as they please. Well I'm posting a letter today to warn them that if I don't get my information within the next 14 days I will apply for a court order to force them to comply with the Data Protection Act.

    Ridiculous it's had to come to this for the sake of some statements.

    Anyway, good luck to all Barclaycard claimers and don't let them get you down!!

    My partner defaulted on this Barclaycard credit card a few years ago when he was a student, most of this came down to Barclaycard keep stinging him with late payment charges/over credit limit charges, etc.

    Now he just pays off the minimum amount a month, and they have put his credit limit down to £0. Do you know if you can claim back credit card charges on your barclaycard which has been defaulted on??? As he wants to claim back nearly 1K worth of charges.

    Any help would be great

    I got a similar response from Barclaycard, saying that they would only refund the difference between my charges and £12.

    I filed for charges for both mine and my mum's Barclaycards and we've both had the same responses. Well to be precise, we've both had the money put in our accounts last week with no letter or anything explaining what the money is for etc.

    The thing is, we both also claimed from Barclays bank and got all of our charges minus interest refunded. Why is one half of the company doing one thing, and the other refusing to do the same?

    We don't know whether to accept this payment or pursue the full amount from Barclaycard, in both our cases the amount we've been refunded is less than half what we were were claiming, although the amounts involved are only in the low hundreds.

    Has anyone been in this situation and refused a partial payment and then been offered more? Thanks, and good luck to the rest of you :)

    yes he can claim back these charges following the procedure laid out in the article in the usual manner. The difference is in the name of the charges he can claim back. He can claim Late Payment, Overlimit and there is a nasty one of £40 called an Out Of Order charge with Barclaycard. Good luck :)

    I have claimed £514.87 from barclaycard (including interest). I have been away on holiday and when I hcome back I have had a letter from them offering me £176 as full and final payment. They have applied this credit back onto my barclaycard.... but i am not happy with this. I want more of the charges back.

    What do I do??? I am not sure because of the fact that they have automatically put the £176 credit back onto my card.

    I am in the same boat, although i am being swayed by Martin's advice on credit card reclaiming that the OFT's recommendation may make it more difficult to push for reclaiming all the money. I'm really not sure what to do. It would be good to hear if anyone has received an offer like this (the difference between the charges and £12) and then pushed on to get the full amount?
  • I have got to the stage with Barclaycard where they say they want to go to court. I've received papars to that effect, but I'm unsure what I should do next. The first sentence in their defence is " Barcalycard is a trading division of Barclays Bank PLC and not a legal entity in its own right." What does this mean? They are disputing all of the claim (about £600 inc. interest). Can anyone advise me as to what my next step should be?:confused:

    Hi,
    My wife and I are trying to reclaim charges from a closed barclaycard account. We sent the initial letter asking for statements and received a prompt reply asking for more details as they could find no record of the account. Previous addressess etc were then sen,t but we have received a letter saying that our account details have been deleted from their main computer!! It goes on to say that if the reason for asking for the statements was to reclaim charges then to send a copy of the letter to their customer relations, which we will do.
    What i want to know is, has this happened to anyone else, it just seems a bit strange to us?
