    Yes its the same process for Bank Accounts or CC's... have a read around the site and see how others have done.. there are loads of barclaycard successes on this site and others...

    I'm having an absolute nightmare with Barclaycard:

    3rd Feb - I sent my initial letter
    I then got a letter dated 13th Feb advising they had received it and my statements would be with me within 40 days.
    25 March (40 days up) - Rang Barclaycard - was told they still hadn't been issued but he would pass my details to their complaint team, and someone would call me within 2 weeks (which I would say is plenty long enough!)
    Gave them the benefit of Easter Monday and called last night. Was told someone would call me today.
    Have just had to ring again and ask to speak to a manager...only to be told there's none available at the minute and assured one would call me back within 90 minutes.

    I have already written to the ICO, but I'm getting more and more cheesed off by the moment. Please tell me I'm not alone.....

    What is to stop someone in scotters position just coming up with an inflated figure and then presenting this to Barclaycard with the note:

    "due to the lack of information on your part I have estimated my claim to be £(big figure) and I will be lodging this with the small claims court. If you disagree with this amount then please provide documentary evidence to the contrary. You have 14 days to comply".

    Surely this would nudge them into action. If not then they would probably pay out the amount stated, they have yet to NOT settle out of court, judging from what I have read on here.

    Is this course of action wrong, what do you think?

    One of my Barclaycard statements shows a hefty £40 for 'out of order' charge. You might want to check for those too.

    Totally wrong to bring court into the equation this soon. They may call your bluff and you end up at small claims court with no evidence of the charges you're claiming for. Case dismissed.

    Might work to make a claim with NO mention of court yet though. Overestimate the figure and see if they correct it. Dont mention lack of evidence. :)

    You arent alone and the ICO is handling thousands of complaints of this nature. Its a slow boiling kettle as to whether anything practical will be done about the banks deliberate failures anytime soon though. You have my sympathy.

    Hi there,

    I sent the letter to Barclaycard requesting £441.40 and I got the same letter that some others on here have received, where they were informing me that they are refunding me with the difference between the charges and the OFT recommendation of £12 - my account has already been credited with £128. I am not going to just accept this. I am not going to accept only this but I want to take them to court but I'm not sure about the wording in the changes of the 'particulars of claim' template that I've made, could you please have a look and tell me if they look all right?:

    1. Between the dates of 16 December 2003 and 13 March 2007 the Defendant applied numerous default charges to the Claimant’s credit account, amounting to the sum of £416

    (2-4 are the same, interest is about £63.30)

    5. The Claimant has requested from the Defendant the total sum of £479.30 but the Defendant has agreed to credit the account of the Claimant only with £128, which is the difference between the charges incurred and the £12 fee recommended by the Office of Fair Trading. The Claimant, however, believes that the OFT fee is only a recommendation and not a ruling and that the default charges applied still constitute an unfair penalty. The Claimant therefore asks the court to enter judgment in their favour for the difference of £351.30

    How does 5 look like? I'm a bit confused because by now the charges have come up to £479.30 because a) I was charged again in the meantime and b) the interest rose, so not sure how to put the first clause, since it's not entirely accurate. Any people who are more familiar with the legal use of language and might want to help please? Thanks
  • Just received my statement from Barclaycard and a credit of £64 has been applied to my account on 2nd April. They havent contacted me with regards to this and I have already posted the second letter a couple of days ago threatening court action.

    Shall I write to them again now saying I accept as part payment. I only have a balance of £71.37 left and they now only owe me £96 so I would be happy if they just cleared that to be honest. Do you think they would deal with it by phone if I ring them?

    You need to reply to Barclaycard and tell them that you expect to receive your bank statements within the 40days allotted to them otherwise you will take the matter to court.
