if theyve already followed up with a no letter, then if you do want to claim more than there part payment, just start court proceedings, you dont need to notify them as they would already be aware of that fact.

i have statements from barclaycard from july 2004 but "all previous records are stored on microfilm and may take another 6 weeks to get hold off, the data protection officor and information commissioner are aware of this".
is this a genuine excuse, or do i go ahead with the threat of reporting them if the information is not sent within the 40 days ( also, is 40 days 8 weeks as in working days or just 40 days ).
if i do have to wait longer, can i claim for the money from july 2004 then claim for the rest when i get the rest of my statements?

The IC may be aware, but as far as I know they have not been afforded any more time. After the 40 days is up, I would let them know they're in breach and inform the IC anyway.
I would also wait until you have all the info before starting your claim.0 -

Hi,
RBS & Barclaycard have offered me the difference between the charges I have incurred and the £12 fee recommended by the OFT. So by example I have a string of £20 charges going back six years, I would only be entitled to £8 for each late charge insteaf of the full £20.
They dismiss the interest I have shown in my schedule using Martin's calculator by the way!
I was told that credit card late charges are treated differently because of the OFT reccomendations of capping such charges to £12 in 2006.
But can these credit card companies use this £12 cap for all late charges prior to 2006?
I would really appreciate some advice on this one.

Hi.
i know this sounds a stupid question, but have you checkedon the royal mail web site, or ring the royal mail, the number is on the back of recorded slip you were given from the post office. If they have got it, allow for Bank holsd out, you should of heard within 10 days.
It would be worth writng again, stating that this is a reminder letter, and as they have 40 days to respond xx days have gone by and you have not heard anything.
Also add that if you do not getthe information with 40 days, you will report them to the OFT and the Financial Obsubmen.
If its any help, there a thread just for Barclaycard, be worth going on to that and follow it though there, theres a few people who are having problems of one way or another with Barclaycard, me included.

Can anyone tell me if it is possible to reclaim charges from a credit card? In particular has anyone had success with Barclaycard?
If you have I'd appreciate some details on how you were successful.
How did you adapt the standard letter asking for details of charges?
