    MUM2ONE - Thank you, I do feel a lot better now, both physically and about my court hearing ; )

    Will I need T&Cs? This is the real sticking point for me, as I don't have them and Barclaycard seem to not want to send them to me. Maybe I should get them faxed to me at work, unless anyone out there has a spare copy or a weblink for the 1999 Barclaycard T&Cs.

    I'll keep you posted. Hopefully they'll settle, then I get Monday off with NOOOOOO stresses involved ; )

    To be honest I wouldnt worry to much about the t+c, how many of us actually keep them, if it did go to court then the defence have to bring a set of documents that they intend to rely on and your get a copy of there file, may be in there.

    They pay the money on to the credit card, and any money left comes as a plus balance, so you have to spend it.

  • hi had another letter off Bcard saying that their offer of £151 from a claim of £670 is fair, and is their final response. of course i dont agree , so do i go to court ,with a risk of a stay ( case against Bcs already stayed) or would i be better off going through the FOS ? any info would be gratefully appreciated ,thank you Geoff

    Start proceedings voa MCOL, claim the lot plus interest and the £10 for statements if you paid that.

    I've given BC over a week to reply to the default judgment, I think I'm going to issue the warrant later today. If you have the same luck that I have then they won't bother acknowledging your claim either, which should save time.

    I don't know how they managed not to though, since they did get my list of charges and the claim forms from the court as I got 2 seperate communications back from them.

    I need to return a form agreeing to certain terms, which include not disclosing the terms of the settlement, which I will respect.

    JUST ONE IMPORTANT NOTE! IF YOU GET MONEY BACK FROM BARCLAYCARD, YOU DON'T HAVE TO HAVE IT ADDED TO YOUR CARD. I stressed very firmly that I didn't want it on my account and that I was closing it (it is actually inactive and I told the legal rep this). If you give them a nominated bank account and details, they are obliged to pay it into that instead. Otherwise, they get the pleasure of you being a customer and potentially going back into the red and running up charges. Boooo!

    Many thanks to everyone who helped me, particularly Mum2One & Sagaris. I am sorry if I have left anyone out, please don't take it personally - I just can't find everyone's details, as I am too excited!!!!

    I will definitely be staying on this board and will try and help many more people get through this tough but wonderful experience.

    I am going to treat myself and my lovely wife to a nice meal out somewhere tonight, and maybe lots of wine so I may be out of action tomorrow!

  • Hi, BANKBANDIT!

    I filed the claim online with MCOL on May 10th and they sent Acknowledgement of Service was sent on May 15th.

    Barclaycard filed defence within a few days and Notice of Transfer of Proceedings to my local court was sent on June 22nd.

    The notification of a Pre-Trial Review was sent on June 29th, with the hearing scheduled for September 10th (this monday), so that is the longest stage.

    All in all then, exactly 3 months to get settlement. If I write to them tomorrow, then I should get the money within 10-14 days.

    They will send letters to scare you first, then they will probably put SOME of the money on your card without asking you. I wrote twice demanding they took it off, which I would recommend you do, otherwise you could end up with a settlement on your card, but other people have then claimed the rest up to the full amount in court. Have a look what other people did too and go with what works best for you.

    It seems that they don't always file defence, but if they do it is a standard response - don't worry about it. Keep pushing with Court proceedings. They should ultimately settle a couple of days before any hearing. Just stay focused and relax. ALWAYS STICK TO YOUR DATES AND DON'T GIVE AN INCH. Don't be put off by 'trial' or 'pre-trial review'. Remember, you are playing 'prosecution' - they are having to defend themselves, because they are very bad ; )

    This forum helped me an awful lot - stick with it!
