    I would wait to see if you get a response in 7 days from them. If you don't then you need to stick to your dates and start proceedings. I refused my part payment and demanded they took it back, so it would be worth finding out from other MSE-ers what experience they had with part payment BEFORE you hit them with MCOL.

    :confused: I wrote to barclaycard asking for my charges back and got the standard letter back. saying they believe the charges are fair etc...

    But as a good will gesture they will credit my account with the difference between the current £12 charge. whaich works out to be £260 i asked for £576.
    What should i do grab it and run or fight for it all??????

    AT the end of the day its up to you but its your money so go for it , they did the same to me and ive just started moneyclaim online to get the rest of my money back but good luck what ever you plan to do, just right back and say you except it as part payment only but will continue to court for the rest of your money

    Do they send a cheque if you successfully reclaim charges? Or just redeem it to your Barclaycard balance?

    They put mine on my barclaycard account, but then I did owe them.

  • I have successfully claimed against First Direct & on two accounts with Capital One but now stuck with my claim against Barclaycard.

    Barclaycard offered me the £20-£12 difference which I rejected & went though the MCOL process with Barclaycard entering a defence at the last possible moment.

    I have now received a copy of BC's defence from Northampton Courts with Judge Murdoch's name at the top stating that the claim will be stayed pending the OFT test case. This is clearly incorrect as the test case only applies to banks & not credit cards, how do I apply for the 'stay' to be lifted?

    Has anyone else gone through this procedure ? if so what was the result ?

  • I have an ongoing claim with barclaycard, they have paid £345 of the £1,100 i asked for... going to do an m-col, (once i recieve my cap 1 cheque for £600+.....also through m-col)....

    One question though, how do you find out when you opened the account?... i know it's years old, but have no idea what year it was... and i remember that you have to put these details on the m-col form.....

    I have been chewing this one over for the past couple of weeks after my local court (Guildford) applied a stay on my claim following the OFT case. Totally unfair, but i am of the understanding that the judges have huddled together and agreed to do this regardless of any rhyme or reason. I am not going to apply for a removal of a stay.

    My initial claim against Barclaycard did not include charges pre 2004 due to the way in which they deal with the Data Protection Act requests. With a significant amount of pre 2004 charges sitting here waiting to be claimed till the conclusion of the post 2004 claim.

    I am tempted and wondering if i could withdraw my current claim? I would then look to find a court that are not grouping the credit card claims with the bank charge claims, file the new claim pre and post 2004 and sit and wait.

    Any help or advice is much appreciated.

    You don't need to put that information on any forms but if you want to find out ask BC.

    ukcrow: BC stated about old data pre 2004 I think was stored on microtape, but the fact is how they store it is not important, they just have to provide the data, as per your request. They might only have a copy in a vault at the North Pole and would have to send someone there to get it, but that is not your concern and they would only have themsevles to blame if they did have to do that.

    I got all mine anyway... and make sure you include the £10 on your claim if you paid to get the old statements as the only reason you need them again now is to work out what they have charged.
