    I took Barcalycard to court using moneyclaim online that was on the 30th Aug it still only says issued what does this mean . surly they must have received claim by now . has anyone else had this problem.:confused:
    please let me know. also ive read on here that credit cards are being stayed too , do you think this is what is happening to my claim:eek: :eek: :eek: :eek:

    They failed to acknowledge my claim with the court but they did respond to me just not through the correct route and as such, I got judgment by default. I was about to get a warrant but they responded and offered the full amount, plus over £150 extra on top of the claim amount (which is probably the difference between the 12 and 20 charges, I've not checked yet) but I shall class this as a bonus, which was paid as a goodwill gesture.

    If you have the same luck as me, then you'll be able to request a default judgement too which would be good because it'll most likely mean your claim will be resolved quicker, mine was done and dusted in 5 weeks.

    The bonus was paid quicker than that though so if you get one of those, then take it as the goodwill gesture that it is :beer:

    No problem.

    The BC one I filed at the start of August. I'm one of the few who managed to get a default judgment, obviously internal confusion allowed mine to slip through the net but if they acknowledge yours it'll take a bit longer.

    You will get a full settlement, if the time for them to respond to the claim has passed then request a default judgment.

    Just remember to only accept any partial payment as just that, without prejudice and that you will continue with your claim for the rest.

    yes already done that only accepted 256 as part payment they still owe me over 600 plus court cost.
    They have 7 days left to acknowledge my claim so lets wait and see what happens :beer: :beer: :beer: hope it doesent get stayed like lots of people on here has :eek:

    Secondly, are people getting paid through the mcols, or have i just done my dough?...i hope not, due to Barclaycard being the 'company' i wanted to get my money back off the most due to the dreadful, shoddy, unsympathetic, and generally s**t service i got when i was made redundant.

    If they request a stay it has been done in error or they are trying it on. I actually got the standard current account stuff through from Barclays about the OFT case and that they would request a stay, if that happens you can have it lifted.

    Don't worry, you'll get the money :)

    You might be lucky then and get a default judgment, if a stay is granted just get it removed on the basis it should not have been applied due to the OFT case as that does not cover credit card charges.

    if its any elp, Credit cards are not in the current stay,its only bank accounts, I went through MCOL, went as far as court date, but BCard settled 3days b4 court.

  • ANGRY GAZZA - the defence that they filed, which you will have copy of from the County Court, states the exact date that you opened the account. This is not important unless you go to trial, as you might need a copy of the Terms and Conditions if it went that far.

    All you need for the MCOL form (summary section) are the dates between which you are claiming for bank charges, which will be 6 years back from the day you file the claim online.
