    Sir Saver or Mum to One could you assist please.

    Barclaycard have been granted a stay on my claim, 'We are a bank stuff & all that nonsense' How do I go about getting that stay lifted ?

    Where do I find the forms or web page to complete

    Hi Dave

    The only thing I could suggest is go to the OFT website, as theres info about bank charges saga, I would print that off and would suggest writing to the court, explaining that the stay is only in relation to bank charges, and as you are recliaming credit card charges, this stay is not applicable, also send a copy of the letter and info to barclaycard.

    If you try that way 1st, def worth a try.

    I wouldnt even bother going by todays OFT announcement...

    does this mean they are defending and i have to go to court or will they go fo ra stay any one else had this happen to them , or won with barclaycard as not a lot happening in the success thread :confused::confused:
  • I haven't had it happen to me, but I did win with BC. When the claim is issued they get a response pack n9_0406.pdf which has various options; accepting the claim or contesting all or part of it. If they contest it they have to submit a claim within 14 dyas, but there is an option for them to "acknowledge" the claim which buys them up to 28 days to submit a defence. sounds like that is what has happened to you. It might just be a stalling tactic, it might be that they will submit a defence. My experience is their admin is not great. Either way don't let it put you off.

    Nope, they've not defended yet, they now have a total of 28 days from when your papers were deemed to be served on them which would be approx 5 days after MCOL Issued the claim.

    Haven't got this far with BC yet, soon I hope, however, this is eaxactly what Capital One have done. Acknowledged claim, given 28 days to submit defence. While waiting for court date received letter from C*apOne stating they are going to defend my claim, but have sent me a cheque for the full amount claimed at court as a gesture of good will and advised me to contact the court to advise them that they had settled.

    BC didn`t settle early so I`m off to court in the morning wish me luck!!!
    The claim is only for £367 + £50 court fees...
    eek... nervous but hey they can only say yes I win or nope I`m not entitled to anything!!
    I`ll let you know how it goes when I come into work tomorrow lunch time!!!
