  • hello all.

    i just in the process of claimg just over 1000 pound from barclay card.
    i have just checked my online account to find that they have refunded 317.54 of this!!!

    now i have three questions if you could all help please.

    1) will they write to inform me that they have done this to which i will reply saying that i will accept as part payment without predudice and second...
    2) can i use my barclaycard to pay for mcol or would this complicate things

    and finally

    3) how much will it cost to claim at mcol for 1010 pounds

  • They paid money to me without telling me too,although they claimed they did but the letter must have got 'lost' in the post.
    Don't wait to hear from them just send them the 'received as part payment with out predudice......... Not sure if spending the money would be classed as you have accepted or not so best to make it clear you will still be claiming the rest - and keep a copy of this letter just incase!

    when i filled out my claim i didnt put what barcalycard had already given me as a goodwill gesture do you think that is why they are disputing
    i have court case with Barclays/Bcard , they always put in a defence, saying they dispute the whole amount, this is a stalling tactic, . ......once they put in a defence it goes to the courts ,so your case does not go any further online,it usually goes to Northampton ,then it gets transferred to a court near to you.and you are given a court date.... what i did when Bcs put in a defence was to send them another copy of my bank charges ( S o Cs ) and also send a copy to the court asking for them to be put on my file.......dont worry keep going and you will get your money back.and dont panic, if you need ANY more info no matter what , ask on this forum , someone will help you ...... good luck Geoff...........,

    Basically the £72.00 they offfered you would be the difference between what they charged you and the £12.00 they now charge, thats a standard reply.

    Justclarifying your post, you had charges for £250.00, they refunded you £100 back at the time 4 charges, leaves £150 + interest owing, theyve offeredyou £72.00, so if you accepted thet leaves £78.00 owing.

    Its a difficult one, there is nothing stopping you making a claim, through MCOL,
    re the offerof £72.00 you write back and say you will accept the money, butit is without prejudice, you will still continue with court proceedings, unless you are refunded in full for the remaining charges £78.00 + interest.

    They may because its a small amount say yep ok, were pay, or they may send you back the standard letter, we believe our charges to be lawful,

    At the end of the day, the charges were unlawful at common law, otherwise they would not be paying out to all these consumers.

    it boils down to personal choice.

    i am gonna write a letter saying that i accept as part payment without predujice.

    do i need to send a revised statement of charges?
    how do i do this and what should it consist of?

    Taking the advice given on my other thread I have drafted this letter to Barclaycard in responce to there offer ( I have rehashed a CAG template slightly to take my own circumstances into concideration)

    this is my letter

    Response to settlement offer.

    Dear sir/madam

    Thank you for your letter dated ******

    I respectfully decline your offer as Full and Final settlement and request, once again, that you return to me all charges imposed on this account, totaling £***

    I will accept the sum offered only as part settlement and only if the amount is sent to me by cheque and on the clear understanding that I will pursue recovery of the remainder, with a County Court claim if necessary.

    My original letter dated 19th July 2007indicated that you had until 2nd August 2007 to respond before I proceeded to the next stage of my legal action. My deadline has now passed.

    If you do not accept my conditions, or you do not respond within 7 days, I wish to stress that I do not accept your offer and the money transferred to my account should not be viewed as my acceptance. I hereby authorize you to remove this sum accordingly.

    I trust this clarifies my position.

    i've just received a letter saying that my case is being transferred to my local court but i haven't received a date yet. from what you say, i'm under the impression that i need to re-calculate my charges and send a new statement to barclaycard and the local court???? i'm scared now :eek:

    Barclaycard have paid up :T
    Capital One have paid up :T

    Written a letter of complaint to Barclays, as apparantly they can't find my Account details :mad:
