    Hi.
    Firstly, dont worry, all it meansis that a settlement was not reached and its gone to the next stage,

    the charges will be the same that you had when you initially wrote to Barclaycard, the onlt thing that changes is slighly is the interst,unless its a massive amount say 3k, the additional interst will be pennies, make sure you account for court charges.

    Congrats with your outcome...

    You say that 'credit cards are not in the same stay as bank charges'... How so? I'm concerned that if I start MCOL that my case will get stayed.

    There were a few cases against banks in the waiting room with me and they were all stayed... The Judge and also the duty solicitor made me wait till the end as my case was different as it was credit card charges and not bank charges.
    The judge said congratulations to me in my hearing after i showed him the letter settling my case and he said that I won because credit card charges are not in the same stay as bank charges!

    Even though I had won before I went into the judge I still was nervous as hell really weird :)

    Anyhoo I got the £417 I was claiming for and the £120 already paid to me as a goodwill gesture didn`t seem to count.
    I had told BC and The Court about the part payment but still got the £417 on top of that :)

    I sent them a letter reclaiming charges a week ago and I received a reply from them today.

    It basically says they do not agree with my legal analysis, and they reduced their fee last year to £12 "following publication of a statement from the OFT" therefore they're not refunding my charges.

    What do I do now? Threaten court action?
  • I had to call MCOL today and i had a good old chinwag with the advisor and we got onto the subject of Bank Charges being different to Credit Card Charges and she told me they realised that CC charges were different to Bank Charges but claims were being stayed as some claimants were not making it clear they were claiming for CC charges and not Bank Charges.

    She advised if anyone had a claim stayed for CC Charges to contact them and make it clear that's what they were and it would be un-stayed.

    I hope this helps some of you...

    Keep to your original timetable and proceed to court action, its standard Barclaycard reply, anything to stop you claiming the money.

    You dont need to notify them that your proceeding to court,

    I was offered a refund of approx £72 and they said I had 8 weeks to decide. Only 7 days has passed since I recieved their offer and I haven't yet replied.

    However last night I got a barclaycard statement showing £72 credit. But I closed this account over a year ago, is this not illegal to re-open a closed account without my permission?

    I didn't just pay the card off, I specifically asked them to close the account at the time because I remember them saying I should just leave it open and not use it etc...and I had to keep telling them I wanted it closed.

    Barclaycard only had until Monday to Defend and they've done it today...Gits!!

    Oh well onwards and upwards!!

    basically its a sneeky move off barclays, it would only be illegal if you spent on a closed account.
