In fact you should send the Letter Before Action giving the bank 14 days notice that you will be taking them to court. You'll find the template in Martin's article here..

The court had put a 'stay' on my case due to the banks court case, I had 7 days in which to reply and have the stay lifted, so I send a reply within the 7 days stating that credit cards do not apply under this case.

I would write back to them, stating that the case was brough originally as a Credit Card case, therefore you feel that the stay was broought inappropiately, and that you do not feel that you should be responsible for the £35.00 fee as you have already paid court fees.
Go through all your paperwork, double check the actual court application, and as long as you have credit card charges wrote on it, then print a copy off and enclose it with the letter.

hello all
i have accwpted, as part payment without predujice, an amount of money from barclaycard. i have sent a letter on the 19 sep say i am oing to claim via the corts for the rest of the money.
problem is i need to us my card!!!!!
will this affect my claim?

Hi everyone hope all your money claims are going well. Anyway just a quick update on my barclaycard claim.
Requested Statements 09/08/2007
Statements recieved 20/08/2007
Sent letter requesting all charges to be refunded including interest totalling £685.63 on 29/08/2007
Received letter back offering differance between £20.00 and £12.00 totalling £256.00.
Accepted offer without prejudice but stated that I would be claiming the rest through the court via mcol.
letter received on 21/08/2007 stating that they had reduced my credit limit to £250.00 (cheaky gits!!) a this basically meant they had took the credit away again after refunding me the £256.00 taking my credit limit once again back to its limit.
Anyway on a better note, got letter today stating that they will give it all back to me apart from the interest which amounts to £556.00 o checked it and now account £20.00 in credit. leaving me to pend the £280.00 on card.
So they fell at the last fence after me threatening them with mcol
So keep it up and make sure you chase them.

Thats brilliant news, re cap 1 if they acknowledged on 11/08/07, that then gives them a 14 day extension to put the defence in, what I would do is go straight on to MCOL, ur claim, and see if you can get a judgement. Good luck xxx rip dad... we had our ups and downs but we’re always be family xx0 -

Re cap one, I will just keep trying to file the judgement, but whats bothering me is noboby has been paid out for a while, i think since mid august according to the thread. But hey maybe they jut havent poste the good news.

I, like I see a few others on here have today received a settlement offer from Barclaycard which as a 'goodwill gesture' amounts to the difference between the charges that I had incurred and their current £12 fee. I also noticed that they said they were prepared to 'credit me' the amount, which I find interesting seeing as the account has actually been closed for over 3yrs now!?
Anyway, I would like to find out if any of you have continued with the threat of court letter in an attempt to reclaim the full amount (with/without interest - I myself started the process claiming with), and if so what outcomes have resulted thereafter?

Hi.
I had to start court proceedings, but they settled out of court, about 3 days to go.
I notice you say the account is closed, but the way Barclays work, think your find the credit will be put on to your card, and they have restated it.
