    Thanks for your reply, I think I will go ahead with the court threat letter and see where that takes me. After all I think being offered £120 of a possible £480 (with interest) is not good enough by any stretch, even without the interest the charges amounted to £360 and no-one can tell me £12 is a true reflection of their costs.

    Is that definitely the case then where you've mentioned that they will have restarted my Barclaycard Account, even though its been closed for so long? Seems a bit daft, and I obviously don't want it either! Will this remain the case if I go ahead with court proceedings?

    Finally, if I am to proceed is it generally thought that the best way is to accept the difference offer as part of that letter? I thought I would just have to refuse it and continue to go after the full amount in one go rather than accepting the difference offer then fighting for the remainder?

    Mine went on my barclaycard, even though it left a + balance, one of the posts afew pages ago they werein same position as you and card was reactivated, as it suited Barclaycard

    What you need to do is write back on the lines of

    Dear Sir or madam (or better if you have the name of the person who offered you the difference).

    account number xxxx

    Re you later dated xx/xx//xxwhereyou offer me the sum of £xdx. which is the difference between the charge and £12.00 that you now charge.

    I accpet this payment of £xx without prejudice to my case, and should I not recive the sum of £xx (the original figureminus whats offered), with 14 days, allowing 3 days for postage at recorded delievery)I will be left with no option but to proceed with court action.

    Where they get the £12 from, is, when it all kicked off last year,the OFT said we will not investage charges that are under £12.00. That bascially gave the credit card companies a green light to reduce their chargs to £12.00

    Be prepared for a letter back, which is standard BCard reply - we believe our charges are fair,etc etc,you signed the terms and conditions, they will not up the offer,

    If you have not heard from them after the 14 days given, or you get a letetr back, saying its being looked at, or we will get back to you within 4 weeks, basically there all excuses to get you to leave off court action, as the reply you have sent them re £12.00 this also covers you re notifying them of court action.

    As for the card, if they settle out of court, at that point ask for the whole sum to be sent via cheque, at that point in time you are in a lot stronger position.

    my money i reclaimed went on to a barclaycard account ive not used for years and thought was closed .i dont even have a card. so i just rang them up and asked them how they thought i could get hold of the money they just took my bank account details over the phone and transfered it .

  • My claim to barclaycard has now been transvered to my local court.
    what will happen now .:eek:
    im getting scared my other two claims didnt get this far what do i say in court and what do i need to take. havent got a date yet , just spoke to person on moneycalim helpline and she said i will get a letter with barclaycard defense on it sometime this week,
    do barclaycard turn up in court its all getting a bit too much now help please , if anyone else has got this far please give me some advice :confused:
  • BankBandit, I am at exaclty the same stage as you. My first advice would be not to worry.

    I have claimed from Cap 1, and they paid in full when I did MCOL. I also have bank charges from my current account on hold against NatWest, so my Barclaycard claim is my only active claim.

    I went thought MCOL and got a letter saying they will defend the whole amount, and it has now been transferred to my local court, Liverpool. I am 99% sure they will fold before I get a court date, but if I do, then I am sure they will pay up before the date arrives.

    If I do get a date, and it looks like they are going to go for it, I will make sure I know my argument like the back of my hand, which is, in essence, that it doesnt matter about the contract I signed, the charges are illegal, and that by law they can only charge what it costs them. The fact that they told me they would charge me is no defence, as telling someone you are going to do something illegal to them does not make it legal.

    I am pretty sure it wont come to that, however, and fully expect them to fold before that.

  • Just a quick update mainly for CLAIREMCATEE.....Keep fighting:T

    Sorry its a bit late, but have been busy working nights on my week off.

    I went through a m-col claim against CAPITAL ONE, they acknowledged, then put up a defence, but before anything else happened, i recieved a letter to offer me the FULL claim amount.......total of £960ish....Once they cleared the balance on the card, i had a cheque for £664 sent out to me.

    Once this was cleared in my account, i then cancelled the claim.

    SO the main point is: I WON!!!!!!!!!!!!!!:D

    Keep going everyone, i have a claim against BARCLAYCARD that was acknowledged 18th of this month for £900+int+costs. so i will update as and when with developments.

    I wrote to barclaycard asking for £580 plus interest, and today I was offered £232 plus 8% interest. not bad for their first reply i think you'll agree!! If i take it mcol and they then agree to pay the £580. who pays the court costs? would this normally be me?

    You pay it out first but you can claim it back as court cost when you win
