Hi - Just wondere whether you could offer any advice...

Barclaycard partially refunded charges claimed without the need for court action - and continued to refused to refund the remainder. Have pursue through the courts and they have offered another part refund.. refusing to refund the interest and court fees.

Can I continue to pursue this via the court as the amount claimed has now altered and if so, what do I advised the court/barclaycard...

Hope it was ok to private message you - first time on the new site and could'nt fugure how to start a new thread.

In addition might I ask whether it is ok to reclaim charges from catalogues etc....

Ok, I need some assistance now.

As in my last posting Northampton Court had lifted Barclaycard 'stay' & sent it to Plymouth Court. Plymouth Court allowed stay, I appealed & now I have a hearing in Newton Abbot Court on 8th November to see if stay is justifed.

Could this be the case that sets a precedent on credit card claims or will Barclaycard finally cave in ? If District Judge Griggs allows the stay for Barclaycard will it set the way for other credit cards to quote in their favour?Has anyone else got to this stage.

Sorry I dont answer your query, but will try and explain a precedent.

If its any help the way a precedent in law happens, if usually set if there is not a specific law that applies, a judge will have to make a decision, and if the answer is new decision, then in theory a precednt can be set, but this does depend of the level of the court, basically the lower court = magistrates court, next higher = crown court and so far, so if a precedent has been made, say in crown court then all the judges in magistrates court would have to follow the same, but if made in a magistrates court, then this does not have to be followed.

I have used the letter templates and received a response from Barclaycard yesterday to my claim.

I asked for £695.00 charges to be refunded to me without interest.

As a gesture of goodwill they have offered me £227.00.

I need to contact them because I no longer have the card and will have to provide them with my bank details.

Can I accept this offer and still continue claiming the remaining amount?

Thanks for advice in advance.

you can accept the amount and still claim, but make sure that you write without prejudice in your letter as that covers you.

(was offered 250.56 and put it on my old card account), so i refused

How about a compromise and phone the bank and ask if they will settle a figure with you now as they would then avoid further costs of having to attend court?

Just wanted to say a big thank you for your help and advice. In the end after much fretting and panicking I decided to go along to the case management conference. I'm so glad I did go, because barclaycard's solicitor spoke to me before it even started and offered to settle! I haven't actually had the money yet, but they've signed something called a Tomlin Order, which apparently means they can't back out, so hopefully all is well and I'll get the money. So thanks again for helping to convince me not to give up!

Hi

I have sent a letter to barclaycard to claim back £408, they offered £111, but i did not accept, but still they credited my account, but i took it to the Money Online court,

today i got a letter from Northampton County Court stating the following

Without Hearing
IT IS ODERED THAT :-
1) Following the filing of a defence or holding defence the claim shall be stayed pending judgement in the Office Fair Trading test case
2) Liberty to apply with an explanation

Note: Any party affedcted by this Order my under Rule 3.3 (5) apply to have it set aside, varied or stayed. Such a party must apply under Rule 23.3 within 14 days of service of this order.
