We are doing a press release next week on how banks are winning a false victory by persuading judges to suspend credit card reclaiming cases. We want to let people know that the hold on bank charges only affects current account charges, not credit card charges.
Did a judge put your credit card reclaim on hold?
We are looking for someone to tell their story to the press about this (probably just involving a quick phone interview). If you are interested please PM me with your name, tel no., and brief details of your situation.<O></O>

hi,
tescos solicitors worded there defence in such a way it looked like bank charges not credit card charges. however tescos paid up in full the next day so it didnt need to be addressed. shows the solicitors are trying it on tho.
Borgbaiterclaimed/settled - Natwest £2,535/£2,535, HSBC visa £80/£80, MBNA £1,258/£1,258, capital one £282/£282, tesco visa £515/£515, HSBC visa £140/£140. HSBC £1,450 MCOL Stayed for OFT case. Chelsea Mortgage charges & cashback £5000/£672. complaints with banks pending OFT Halifax £30, A&L £35. TOTALS £11,325/£54820 -
All 3 of my cases stayed , 2 Barclaycards ( mine & gf ) and one Barclays bank.
All due in court last month after waiting since Feb .. gutted.

I have successfully claimed 2 Bank Accounts and a credit card account winning every penny, this year, both pre and post test case announcement.
The accounts were joint, and also the credit card was just in my wifes name, but I have helped her take them to court. We have won well over £3,000.
I have posted a few times on here and am well clued up to the system.
This latest credit card that my wife is claiming for is at the stage where the bank has applied for it to be stayed and the judges agreed for a second time, the first time was at Northampton and after filling out the appeal and winning it she was issued with an allocation questionaire because it was transferred to our local court and now the bank applied for another stay and won it at the local court. Now she is applying for yet another stay to be lifted, filling out again the N244 form and submitting supporting evidence AGAIN.
My wife says she is happy for you to have her details for your newspaper report. It isn't complicated, just a straight forward claim for credit card charges of over £600.

details for you.

I have two claims with Southend Court for Barclaycard charges, that have been stayed. Despite writing to the court twice, the 2nd time using the two page legal arguement I found on these forums (quoting human rights, OFT Cases etc), the court are refusing to admit that they are wrong, and will only lift the stay if I pay a £75 fee.
This I would be prepared to do, if I could re-claim it, however as I am not unemployed, in-prison, on benefits, an immigrant, and earn more than minimun wage etc. and actually contribute my taxes to society I am not allowed to re-claim the £75 even though the court's desicion is an incorrect judgement of fact and law.
However to slightly temper my displeasure in the court system, the same day I got the last letter from the court ensisting that I have to pay, I got a letter from Barclaycard saying they are paying the claim in full!
I am hoping that I will get a similar letter for the other claim in the next day or so from Barclays.
The court also did the same thing with charges I had from a Cahoot credit card, however they also paid up anyway.

I had a case stayed on late Tax Return Penalties. HMRC eventually withdrew their defense when I asked for case to be re-instated and we won the Appeal Tribunal. Was eventually refunded tax paid in 2010 in July 2016 but interest only for a few months.Taken compensation claim to The Adjudicator Dept. They could not deal with a Tribunal "finished" case properly, so have taken case to Parliamentary Ombudsman who are now considering. I think HMRC were wrong at three levels: evidence,Engllsh tax law and administration. The Adjudicator is not independent of HMRC as claimed also. Let me know if you want more detail.0

Oh, I don't know.
After all, it was three years before the invention of the ipad, so she might still be clacking way on her typewriter*, desperately trying to meet her deadline...
*For our younger readers, a typewriter was like a really heavy laptop with its own built in printer, but without any wifi.0
