  • Going through a m-col with Barclaycard, recieved a "NOTICE OF TRANSFER OF PROCEEDINGS" today...

    it reads:

    To all parties

    A defence to this claim has been filed.

    The claim has been transferred to the court covering the area where the defendant lives or carries on business.

    Please read the accompanying documents carefully and note that the allcation questionairre should be RETURNED to the Bromley Court.....


    Thing is, THERE IS NO FORM IN THE ENVELOPE, just photocopies of which i presume to be their defence.......and also the date on the letter is the 4th October and it only arrived today....

    18 DAYS!!!!!!!!!!! bloody posties.

    questions are;

    a) Should i ring Barclaycard litigation team and inform them of the problem with delay in getting this letter?

    b) Should i have definitely got an allocation questionairre?

    c) how do i stand as regards "timings"?.....

    I got the same thing about four weeks ago it means that Barclaycard have put in a defence and it will go to your local court, in my case i didnt have to fill out the allocation form so maybe its the same for you. Dont bother calling Barclaycard they say they are not making any more payments untill court date.as ive tried that already.:mad: I called my local court and they say it will takes weeks and weeks to get a court date as they have sucha back log, hope this helps good luck with your calim

    Bit silly that the paperwork tells you to return a form, but then not include one with the letter is'nt it?....

    Do you think i'll be ok regards the timing issue?....that is what i'm worried about, but if i don't have to return anything, i suppose it's irrelevent.

    What's the next step then.....sit and wait for a court date?

    I had the same thing months ago...it should say somewhere...in this case the allocation questionaire be dispensed with, re-check your papers.
  • After having very amicable chats with Richard Saunders in Barclays Litigation department i yesterday received an out of court offer for the full amount including interest and court costs.


    Thanks guys including Martin for all your tips and advice to help...it's not just a victory for me but for us all :T

    Guess what? I got the same letter yesterday all charges plus 8% interest ( strange really how they calculate it as it's 8% of total and not 8% of aech charge since charging date) I'm happy except for the fact that they credited to my card ( Account has been closed for a coup[le of years ) but called them today and they've credited it to my bank account:j :j :j :T :T :T and I didn't even have to file at court!
    :rotfl: Surely life can't get any worse it has to only get better from hear on out :j

  • Bloody explains it all!!!!!!!!!!!!!!:mad:

    Got my copy of the "defence" from the courts 5-7 days ago, approx a month after filing an m-col.... it said within the letter to fill out the allocation questionnaire and return it to the court...... BUT, I HAD NO QUESTIONAIRRE in the letter....informed the court, they were not sure why that was the case and said they would send one out...

    Then today, i recieve my allocation questionairre in one envelope, and another from the court informing me that my case has been STAYED til mar 2008...

    Makes you wonder if that was the reason they did'nt even bother sending it to me in the first place!!!!

    Is my next move ringing the court and clarifying that it is A CREDIT CARD CLAIM?

    Thanks in advance for any advice.
