    Barclaycard is a credit card and the suspension should not apply.

    Thanks Edinburghlass, i will check my messages now.

    There as been a development today:-

    My case was on stay, and my local court refused to lift it. Barclaycard had not requested the stay - it was automatiically applied by my court.

    In a change of tact, after getting nowhere with the court, i wrote to Barclaycard pleading for them to settle, and pointing out it was immoral for them to accept a stay that they were not entitled to.

    To my shock, they have today refunded all my money....... BUT....

    No interest, which i would not have been bothered about, had i not already filed at court......

    and no court fees paid - which leaves me £120 down.

    If i cancel my court case, will i get the £120 back from MCOL? I would not be bothered about interest in this senario.

    If not, any ideas what i should do now?

    I instruced the baliffs 2 MONTHS AGO, to collect money won in July from Barclaycard for my friends.

    The baliffs were TOO SCARED of Barclaycard to go in, so my friends case is in limbo.

    As with my above post, i have therefore written to Barclaycard direct, asking them to pay the warrant.

    Whats a shambles the UK courts and baliffs are. Had they been collecting council tax off a pensioner, i am sure that they would have kicked their door in by now.

    I think you need to change baliffs or if they were court appointed baliffs go back to the court, at the end of that is the money your entitled to, this time I know it sounds daft but your in a stronger position, you have it on paper that you are right!

  • I have received a transver of order form as barclaycard put in a defense, what happens now as this was on the 21st sep and havent heard any more since i called the court and they say it hasent beeb stayed so what now, havent had a court date or anything as yet. has anyone else had this happen
  • Just called the court again and thay say it went in to the judge on the 5th oct and they have a big backlog so just a waiting game now to see what happens they say i dont need to do anything else untill i hear from them . :confused::confused:
  • My claim against Barclaycard was put through to my local court. I have just received the above and it says the following:

    Before DISTRICT JUDGE WILLERS sitting at Hitchin County Court.......

    Upon Reading the Court file

    IT IS ORDERED THAT

    1. The claim be stayed pending the outcome of the test case in the High Court
    2. Neither party has permission to apply for removal of the stay until the case in the High Court has been heard and determined

    What should I do now? I thought the OFT case was purely for bank charges - not credit cards.

    Any help would be very much appreciated.

    Your case is stayed

    Since the OFT announcement in July 07 banks have been asking for bank charges’ court cases to be suspended until there is more clarification on the legality of the charges, and some county court judges have been granting these requests.

    A few banks are also requesting that credit card claims be suspended, and sadly local court judges have also been stopping these cases, although the OFT test case is specifically about current accounts.

    If this happens to you, contact the court to clarify that your claim is in relation to credit cards. It should either suggest you request a removal of the stay, by completing form N244 and paying a fee of £75 or that you write a letter to the court explaining that you wish the stay to be removed and why.

    Writing a letter in the first instance would save you the £75, although you would get this back if, and hopefully when, you win, and if this doesn’t work you can put in the official form afterwards.
