  • Consider yourself satisfied at this stage as they are unlikely to pay the interest without a fight. The interest is a court option really and is seldom paid without going to battle. Also the court unlikely to action if the claimis only for interest.

    Well done for getting this far without court action,
    Firstly, sounds daft, but double check all the letters that you have sent them, making sure you requested the interest. If you have not then, sorry to say but you cant ask for it now.
    hopefully you have asked for interest - if you have

    what I would do is write direct to them explaining that the payments sent so far have covered the charges, but not the interest as mentioned in the letters dated xx/xx/xx, and to date the interest is £xx.xx

    That if you do not recieve this payment within 14 days, you will have to pusue the matter through court.

    At the end of the day, I totally agree with you, if those charges were not put on the account in the first place, you would not be in this position, and at the end of the day you are only asking for interest at 8%, considering that you may have been charged 19% apr.

    if they have virtually admitted they are in the wrong by returning my refunds then they should have to pay the intrest that goes with it!!!

    Forgot to say that when I had my settlement ( that was 3 days b4 court), they had not added my interest on, but as I had mentioned interest from day1, one quick phonecall and they refunded it.

    i appricate that is a different senerio than yours but, it shows they do pay out.

    They have admitted nothing - it was a 'gesture of goodwill".

    It is only the courts or FOS that can award interest. None of my offers have included interest, although my firends did, by mistake.

    For the trouble of going to court or the FOS, i would expect interest. But not if they have paid out before.

    I wish i had been offered my money back. My case against Barclaycard has been stayed by the court until February.

    As any interest is awarded by the court, the judge/court would take a dim view of you turning down the full offer of your claim and taking your claim to court for the interest, which is in effect what you would be doing.
  • I agree with Techspec and Edinburghlass. It may be hard to accept but even though you have requested interest only the courts can really consider it.
    That said it is still worth a phone call to say thanks and by the way what about the interest which I have been asking fo as well as I am in a case of extreme hardship that has been compounded by the charges and this in turn has caused me considerable stress, on top of my unexpected redundancy and having had to borrow thousands from relatives to try and clear my debts .... grovel, grovel etc.
    You never know, you might be the lucky one who gets the sympathetic ear of the day. :rolleyes:

    Barclaycard did their usual trick stating they were a bank & applied the OFT reason for getting a stay in Northampton Court. Northampton CC gave in & stayed the case

    I applied for the stay to be lifted using the N??? form & ammended template letter & £35, got aletter today stating the case had been moved to my local court (Plymouth).

    Now it's another waiting game will it get to court or will they cave in the day before court ?

    has anyone attended court & tried to get self litigation costs /

    Things have moved on with the case arriving at my local court. Just received a letter stating 'In thi scase you are pursuing a bnk on th ebasis that he terms & conditions were unfair & so on to quote the OFT case on July 25th.
    So stay lifted by Northampton only to be reinstated by Plymouth Maybe they are after another £35 & N??? form to be completed.

    We fight on, maybe Christmas will come & go but I won't give up.

    Has this happened to anyone else in their local courts?:confused::confused::confused:

    I wrote to my court last week.

    I pointed out that i had come to them for help after my credit card had ripped me off £30 a time for charges.

    I added, "So if you think that i am paying you £35 to rip me off even further, when its your mistake, you have another thing coming".

    In the part where is says how can we improve our service, i put "Stop being in the pocket of big busness"

    I can look forward to an heated response or a night in the cells.

    certainly think yout letter will of ruffled a few feathers at the courts!
    To be honest I do not think you have done yourself any favours with the court, I can see where your coming from, but have you tried writing to them plitely stating that this is a misunderstanding as its not a bank claim, but a credit charge claim.
