    Barclaycard had until Saturday to acknowledge my claim on MCOL which they've done today...

    Your post gives us all hope that we'll get settlement before having to waste time appearing in Court.

    Another result....

    I was going to request a warrant today, after the court received no acknowledgement of my claim or the default judgment.

    Now I don't have to bother as they are going to pay in full (just over £600), I might pay into another account too, them sending a cheque is also an option). I also got a bonus of just over £150 :rotfl: which was already paid as a gesture of goodwill after I started proceedings ;) It seems like the left is not talking to the right.

    Hopefully others will have as much luck with BC.

    5 weeks from start to finish :P
  • does anyone know if it is possible to claim missed payment / late fees from a bank loan and if the answer is yes then if it affected by the oft case we are all waiting on

    Is it possible and it is not affected by the OFT case, so I would suggest starting proceedings as soon as you know how much you are owed.

    barclaycard owedme just over £800. after first they offered me £249 i then wrote back saying that id accept £400 coz my account was in direneed of some funds and otherwise id never get on top of it. i basically put that in my letter. i wont see the money since it'll just pay off my balance but the relief is immense! now to sort out crap 1!
  • Hi, BANKBANDIT!

    I filed the claim online with MCOL on May 10th and they sent Acknowledgement of Service was sent on May 15th.

    Barclaycard filed defence within a few days and Notice of Transfer of Proceedings to my local court was sent on June 22nd.

    The notification of a Pre-Trial Review was sent on June 29th, with the hearing scheduled for September 10th (this monday), so that is the longest stage.

    All in all then, exactly 3 months to get settlement. If I write to them tomorrow, then I should get the money within 10-14 days.

    They will send letters to scare you first, then they will probably put SOME of the money on your card without asking you. I wrote twice demanding they took it off, which I would recommend you do, otherwise you could end up with a settlement on your card, but other people have then claimed the rest up to the full amount in court. Have a look what other people did too and go with what works best for you.

    It seems that they don't always file defence, but if they do it is a standard response - don't worry about it. Keep pushing with Court proceedings. They should ultimately settle a couple of days before any hearing. Just stay focused and relax. ALWAYS STICK TO YOUR DATES AND DON'T GIVE AN INCH. Don't be put off by 'trial' or 'pre-trial review'. Remember, you are playing 'prosecution' - they are having to defend themselves, because they are very bad ; )

    I have already won with nationwide and cap one but just wanted to know if barclaycard dugg there heals in :eek:
    Nationwide were a pain to deal with but paid in full after i did money claim online and so did cap one didt have to go to court at all they both paid in full so hope Barclaycard are the same

  • Hi there fellow reclaimers.

    I'm new to all of this so please excuse my ignorance here.

    I sent a letter to Barclaycard requesting that they pay me back £808 worth of charges applied to my account.

    I've received a letter back from them statin that they 'disagree with my legal analysis' (:p), and that the charges are 'fair' as they are 'made clear in our terms and conditions'. However they are still willing to offer me £213 plus the 8% interest - which is the difference between the charges incurred and the interest.

    Their were about 40 charges in total, most of them £20 ones, and only 5-6 £12 ones.

    Is it worth taking them to small claims to get the whole lot back or should i just accept ?

    Wot are my chances in court ?

    I have today received a Final Response letter telling me that they confirm the amount of charges paid by me but as they've already paid the difference between the £12 charge amounting to £440 they are not going to pay me anymore.
    Is it now that I start the MCOL?
  • I would wait to see if you get a response in 7 days from them. If you don't then you need to stick to your dates and start proceedings. I refused my part payment and demanded they took it back, so it would be worth finding out from other MSE-ers what experience they had with part payment BEFORE you hit them with MCOL.

    Hi al true to there word barclaycard credited my bank account with £300 from my claim , instead of sending me a statement with a balance on it cos its a closed account...
    well need to look for a telly for the kitchen ,,, so laters ... all
    Im not really mad...
