    Thats brillinat news, give them a ring, but you will still need to put it in writing, I did mine via email then followed up via post,

    One thing I would say is make it clear from the start that you do not want the money crediting to the Barclaycard account, even if its closed they have a habit of reopening to suit there purposes, so stress you want a chegue, but also give them a timeframe, say 14days otherwise you will continue with the lawsuit.

    Sorry for being quiet but I haven't been at all well for a while ; (

    Anyway, thank you to Mum2One and Sagaris again for previous help - I just want to check last details before PRE-TRIAL REVIEW ON MONDAY 10TH! AAARGH!

    Now then, Barclaycard had sneakily paid £181 of the £640 they owed me onto my deactivated card. I wrote several times saying I didn't accept the payment and I wanted them to take it back, which they still haven't done. Can I still refuse this money and persue for the lot through court?

    Or do I NEED to write to Barclaycard saying that I accept it without prejudice and will persue for the rest, in which case, don't I need to refile my claim?

    For my pre-trial review, there was no AQ and I wasn't asked for a court pack. Am I going to need to take copies of everything on this occasion? I have prepared:

    Copies of statements
    Letters from Martin's templates to Barclaycard
    Responses from Barclaycard
    Online County Court Claim
    Response of Defense from Barclaycard
    Notification of Transfer of Proceedings
    Pre-Trial Review notice

    DO I NEED - any of the case studies that seem to be sent around? Or the House of Commons or OFT delclarations that charges are unlawful etc? ALSO - WILL I NEED T&Cs? I opened my account in 1999. I have asked Bcard for them but have not been sent them. Will my case be thrown out at Pre-Trial Review Stage without it?

    Can someone help?

    As you can tell - I am panicking about this now!

    Any more advice greatly appreciated.

    i have just sent off for my bcard statement and having read alot of this thread is sounds like im up for a fight.

    but i was wondering?

    you say that the oft will not stay on c/c charges of 12 pound or less......
    but i know i have charges from years ago that where 30 pounds on myc/c.

    now if this goes to court then will it get stayed bcause its over 12 pound?

    Hope your feeling better, thats gd news bout ur hearing date, theres a gd chance they willsettle b4, or you could be cheeky and ring the litiguation dept, there number should be on one of the last set ofl etters.

    Basically only take what you need, ie copies of letters that have been sent back and forth,
    Online County Court Claim
    Response of Defense from Barclaycard
    Notification of Transfer of Proceedings
    Pre-Trial Review notice
    Copies of statements

    Rule of thumb, dont take anything that has not got your name on it.

    The just of a pre-trial review, is a review of the evidence, and basically its throwing a last chance get out clause ie they settle.

    I would do 3 copies of everything, all filed, one copy for you, one for the defence and one for the judge.

    Penny to the pound, they will either settle b4,on the day or doubtful ifthey turn up.

    The just of the £12 rule,is OFT will not investage claims below £12.00, basically the OFT + credit card companies agreed to not charge over £12.00,but any claim arising before that ruling is ok to claim on, justhang in there,as long as the charges are within 6 years your ok.

    just a quicky..... what happens if the charges you are claiming are more than what you owe on your credit card?

    will they pay of te c/card and then send a cheque for the rest owed?

    Will I need T&Cs? This is the real sticking point for me, as I don't have them and Barclaycard seem to not want to send them to me. Maybe I should get them faxed to me at work, unless anyone out there has a spare copy or a weblink for the 1999 Barclaycard T&Cs.

    I'll keep you posted. Hopefully they'll settle, then I get Monday off with NOOOOOO stresses involved ; )

    A pre-trial review or Preliminary Hearing is to decide if your case will go forward to a full hearing, have a read of this thread...

    If you require a full Court Bundle this will be asked for by the court and you will be given a date as to when you have to send this to the court and the bank.

    Take along your list of charges, statements and any correspondence you have from the bank.
  • ive been busy reviewing my bank/credit card charges
    and sending out tempelate letters provided so kindly by mse

    using the 1st tempelate and sending it promptly to barclaycard

    within 7 days they had refunded 50% of my charges (they simply sent a new statement and didnt disclose what the credit was for) and place the funds in the closed credit card account of which i requested they pay into my active current account held elsewhere, they did!!

    in the interim im received an offer from halifax card services offering me

    50% of the charges and requested that if i accepted that i had to sign a full and final settlement, halifax sent a detailed response in comparison to barclaycard

    my plan of attack

    i have sent a precourt letter to barclaycard using mse tempelates
    stating that i would like 75% of the charges and stating that i was not happy with the 50% payment

    i have also sent a precourt letter no2 to the halifax requesting 75%

    having the confidence to play hardball on the basis that barclaycard where so eager to hand over 50% with no fight

    a further note on halifax card services

    my 1st letter of complaint was fobbed off with they have to cover their costs

    the pre court resulted in a 50% offer

    i would also recommend sending everything special delivery £1.50

    makes people nervous and can be used as evidence if you ending up in court

    otherwise they could state they never received vital eveidence
