    Hi all

    After being offered £209 against my £803 claim I replied to Barclaycard with a letter accepting the part payment without prejudice and saying I still wanted the full amount, threatening with court if needed.

    I received the following reply:

    "i note that you are dissatsiedf with our offer to refund £209, however, our position remains that we believe it is fair when customers' break the terms of their agreement with us, we recover the costs. Therefore, i am not prepareed to consider your request for any further refund."

    Blah blah, it then goes on to say....

    "If my reply does not m
    Hieet your expectations you may ultimately be eligible to refer to the Financial Ombudsman Service."

    So what do I do now? Is it likely that if i pursue i will get a higher offer or the full amount?? They can't really prove that sending the letters each time you go over limit costs £20-£25 can they????

    Also, i still use my barclaycard and have around £600 on it. Can they cancel it and make me repay immediately???

    First thing, dont get stressed, I know its easier said than done, the letter is standard bcard reply, just carrying on pursueing as normal, I did got the full amount, interest and court costs back, they settled b4 the court date.

    Just stick to your guns, remember if it went to court Bcard would have to prove exactly how much it costs to produce a letter, and they wont want to do that.

    ok i am now in the same situation as northernchick - they have given me their final offer and have said thats all and i can go to the FO if i want...
    so what now? do i apply to the court and should i send barclaycard a letter telling them that is what i am doing and when i win i will be expecting all charges + interest, court fee's + self litigation fees??

    i didn't put any of that in my last letter - just that if i didn't get a satisfactory response i would take it to court etc

    also - stupid question i know, how do i go about taking it to court and shoudl i wait until i get back off holiday at the beg of oct to register as i dont want it going to court while im away

    basically now, ignore barclaycard, u've given them enough chances to pay up and there digging there heels in.
    Next step is court action, theres 2 ways of doing it, either online, ( I did thats the best if you make a boob up they wont let you get to the next screen), or fill the forms in that you get from the local court office.
    Online, put MCOL in search box, (Money Claim On Line, its done by the courts), to get the info you need to fill in the form, go to Martins bank charges letters, last one in the pile), just swop account number and amount, they take care of everything for you, thye notify Bcard, they then have 14 days to acknowledge the complaint, if they do they then have a further 14 days to put a defence in, if they do it then gets transferrred to your local court, re hols, all I did was once I knew it had been transferred to the local court, I wrote to them direct with the claim number and a list of dates that I was going to be away in the next 6 months.
    make sure you add the interest on to the claim as well as the fees.

    Dont worry, you claim the amount left after payment, say you had £800 charges, they paid you £400, leaves £400.

    You claim £400, but the interest on £800, from memory, think there is a box that relates to court fees.

    Your court bundle is any documents you want to use in court, basically copies of all letters that went back + forth, you need to 3 copies of each, 1 set for you, 1 for bc and 1 for the judge, Bc will do the same, thats basically what you both refer to.
    Its very unlikely that it will get to court, but its better to be safe than sorry, but good luck x

    please can anyone advise, im in the process of taking Barclaycard to court through MCOL ! im at the stage of judgement as they have ignored everything so far.. the address used was the PO Box address, however to start the warrant stage you cant use PO Box address.

    Does anyone know what other address i can use as looked in the forums etc and cant find anything.

    Hope someone can help me.

    I had closed my Barclaycard in November 2004.

    About 2 weeks a go I wrote to Barclaycard with a cheque for £10 requesting copies of my statements for last 6 years.

    They wrote back saying they totally disagree with my assumption that the charges were unfair - funny because I didn't mention anything about the charges being unfair - I simply requested last 6 years statement using the template 1 letter ftom this site.

    Then the letter said, as the account has been closed they are unable to locate my statements. However they have offered me £100 as a goodwill.

    Can someone tell me what I should do now?

    hi all, im looking to claim by barclaycard fines and would like to know if i can send a postal order as i do not have a cheque book.

    any relies would be grateful
