    I've just requested a default judgement as BC failed to acknowledge the claim. I think a matter of crossed wires, since I did get a letter about the OFT case, which I think was in relation to the claim documents, then another letter about the list of charges I sent to them, saying they have acknowledged my complaint, but they never acknowledged the court documents with the court, could mean it gets resolved a bit quicker.

    Barclaycard have told me that they disagreed with the data protection act 1998 and that they will not be sending me anymore tan they already have.

    Basically all my charges are from 5 years old and over. I know this because I defaulted and it was transfered to a debt collection agency. I was struggling having just graduated. That was 5 years ago. My charges only occurred on this 6th year, hence the reason I defaulted. I actually have a few statements, but I need them all really as I only have the statements which totals £60 and £24 interest. I want to claim as much as possible, then have a condition that I will accept their offer on condition that they remove my default notice, as it still stands on my credit record till October 2008. That will enable me to get the best rate mortgage.

    What I want to know if anybody knows the answer is how can I make them send me my 6th year of statements or microfilm that I've asked for. I have threatened them with the information commissioner. I have got all the forms and information to send them off, but thought I'd check on here first to make sure what will happen. I was disapointed, because although on Martins home page of Bank Charges reclaiming it says to contact the Information Commissioner, but when you read Information Commissioners home page complaints, it says they will not enforce the banks! So some threads talk about taking the Banks to court and indeed there are templates for it on CAG, but the templates are for claiming damages which is very tricky, so I'm wondering can I claim for my £84 without prejudice and at the same time make a condition that they give my my final year statements. This has been going on since April and I really want to get them to be accountable.

    Anyone know anything about this please help, thank You.

    If your sucessful and getthe default judgement, it means you won the case, the OFT etc are sort of used as a back up defence.

    I have a court date at the beginning of September with BC... The letter I got from the court says the defendant (BC) doesn`t really have a chance of successfully defending the claim.
    Anyhoo I dont even know where to begin in making a court bundle or even if I need one... :(
    Can anybody help??

    Your court bundle is any documents you want to use in court, basically copies of all letters that went back + forth, you need to 3 copies of each, 1 set for you, 1 for bc and 1 for the judge, Bc will do the same, thats basically what you both refer to.
    Its very unlikely that it will get to court, but its better to be safe than sorry, but good luck x

    I hope someone can help me. Barclaycard owes me just over £800 incharges. Yesterday I recieved a letter offering me £248.00 as I owe them £909.00 it will just go off my balance. Ive written a letter back (but not yet posted b/c i wanna do sd so i know they recieve it) asking for £400.00 but that i now it'll go off my balance and will hopefully help me get my account back in order. all their charges mean im always overdrawn and i really wanna get this card sorted as its my last credit card. do you think its likely they'll give me the £400 or are they more likely to stick to their £248 offer? im also thinking of asking if theirs anyway they could freeze interest or something to give me half a chance of getting this paid off.

    any help/advise you can give is appreciated.

    hi,if it was me i would go for all the money they owe you,dont let them scare you,its 900.00 off your card when alls said and done,dont settle for less,if you owed them they would take less lol,good luck.mo
  • Hi all

    After being offered £209 against my £803 claim I replied to Barclaycard with a letter accepting the part payment without prejudice and saying I still wanted the full amount, threatening with court if needed.

    I received the following reply:

    "i note that you are dissatsiedf with our offer to refund £209, however, our position remains that we believe it is fair when customers' break the terms of their agreement with us, we recover the costs. Therefore, i am not prepareed to consider your request for any further refund."

    Blah blah, it then goes on to say....

    "If my reply does not meet your expectations you may ultimately be eligible to refer to the Financial Ombudsman Service."

    So what do I do now? Is it likely that if i pursue i will get a higher offer or the full amount?? They can't really prove that sending the letters each time you go over limit costs £20-£25 can they????

    Also, i still use my barclaycard and have around £600 on it. Can they cancel it and make me repay immediately???

    they did the same with me,same letter,i have filled at court and should hear something this week,i dont think you will get it all back unless you go for the court route,so if you want to do that your next step is accepting there offer as part payment then sending then a letter before action giving them 14 days,i owed them some money and still do,i still keep up with the monthly payments,and when i win in court it will clear the card.mo

    Excuse the expression, been there, done that, brought the t-shirt, its standard barclaycard burp, other people on this forum have all experienced the same, dont offer to settle b4 hand, just carry on throu, and a peeny to a pound, your sell full settlement, interest and any court fees all refunded.
