  • So, I'm going to reclaim by credit card charges from Barclaycard, do I just use the bank template letter or is there a different one I need to use?
    Thanks

    Hi.
You use the bank charges template, but just change the word bank etc to Credit card
    Good luck

    Hi everyone
I have initiated a claim with Barclaycard Visa for £703. The have offered and paid me £240. I have written saying I only accept without prejudice etc and said I am continuing with claim. Just rec'd their refusal to go further and now taking to court in Scotland. I am opting for Summary Cause Summons because interest and Costs will go over the limit for small claims...am I right? Also want to make a point of telling court that after 10 years on same limit, Barclays chose to reduce my credit in response to my request for statements! Any advice would be greatly appreciated.
    Thanks. M

Your claim should be under the £750 limit as the court costs and interest aren't part of your claim at this stage.

after first letter to Bcard they made me an offer of £150 of a £427 claim, and put it into my account, iam not going to accept this and want to go for the whole amount ,what should i say in my letter to them ??

    Hi
This should cover what you need

Write to the person who the letter was signed by
    Dear xxxx
    Barclaycard Account Number xxxxx

Further to your letter dated xx/xx/xx where you offer me £150.00 in relation to my claim of £427.00,I further note tha you have credited my Barclaycard account, I am not prepared toaccept that payment, and I willbe contineing my claim for the full amount + interest +charges.

    Yours truly

    xxxx

Dont worry, your get the standard letter back from Barclaycard stating that the believe the offer to be fair etc etc, and they dont agree with your argument. Its a standard reply they send, its just to get you tro settle early and therefore they do not need to pay you any more money,

One thing I would say is, keep to yuor original timetable.

    good luck

Just got a letter telling me that Barclaycard have credited my account with £346............my claim is for £1332.31....

Is it worth writing and trying to get them to 'up' their offer, or do i go straight to m-col now?

    GAZ.

To be entirely honest iwouldnt waste the ink they only offer the difference between £12.00 and what they charged.

Make sure youwrite to them saying that you are prepared to accept the £346.00 as part payment without prejudice, but you will be contineing with your claim,

Main point keep to your time table of events, dont give them any grace.

I have instructed the baliffs to pay Barclaycard a visit on behalf of my friend. They should not have wound me up, by deciding to defend MY claim.
  • Hi Guys,

After another piece of confirmation/advice please....today i received the letter i was expecting which said we've paid you what we think we should not what you think so sod off.....

Well i'm not going to sod off.....so i'm just doing MCOL unfortunately £60 worth of the charges are for 6 years yesterday i.e 15/08/01 i'm guessing that under the statute i can now not claim for these and so i need to rework my figures and interest?

    Could someone please confirm this?

    Many Thanks in advance....

R Barclaycard quick to respond? Crap 1 have been really good with me, replying within a week to each letter. I sent my request letter to Barclaycard today, by Special next day delivery so hopefully i'll hear something soon. How long has everyone else had to wait?
