 :T  :j WELL DONE:j  :T
My claim was for around the £800 mark They offerred and paid into my credit card account , still active, £ 360
( In the same post came a letter that they had reduced my credit limit by £ 600 )I hope I do not get any more charges now
I sent a reply that I accept this as part payment without prejudice and intend to pursue via legal action if nec within 14 days ie want the remainder Letter today - Very polite- Dealing with it , very busy and I will get a response by 29th August
This may be delaying tactic and I should be starting MCOL on 14th August However this will cost and I may get a good offer if I wait till 29th August
Advice please0 -

What ever you do keep to your original timetable, if you were due to start MCOL on 14thAug, yes it will cost you, but youwill getthemoney back when you win, and if they settle out of court, they pay charges, dont be put off by them being polite and helpful, its a delaying tatic.xx rip dad... we had our ups and downs but we’re always be family xx0 -
Could anyone help me. I am planning on startin mcol for barclaycard this week but iam a bit confused having accepted an offer for part payment without prejudice etc. Do i issue the claim for the remaining amount or the full amount, informing the court of the part payment? Any help would be greatly appreciated! I dont wana make a mistake

Hi all in the process of going to court, had my court date through and was preparing for the 3rd september. But had a letter from the court today stating that it is ordered that: the claim is stayed until further order with a view to awaiting the decision in the test case. I can apply to lift the stay by application on notice. Any thoughts?? I thought that it didn't affect claims that were to do with credit cards only Bank accounts. I've alot of work to do togo to court and don't want to waste my time. Anyone else had a simular letter recently?.

When you fill in the form, you put charges seperate from interest, so for the charges, say they were £800 and you had £600 back, then you put £200, on the list, but the interest put for all the whole amount, hope this helps.
Cheers

Could anyone help i am putting together my court bundle and need the Terms and Conditions between 2004 and 2005. I've seach the site and CAG's site for them but can't find them anywhere. Does anyone have them or know of someone i could PM for them. Any help much appreciate.
 Also how do I go about having my stay lifted.0 -
Having today phoned Barclaycard to see if my letter to them has reached them as Royal Mail Recorded Delivery is totally useless at the moment i found out that they had without my knowledge paid in to each of my closed accounts, a nominal payment.
I will today write to them accepting without prejudice these payments as part-payments but my question to those in the know is....if i ask for this money to be transferred to my bank account in the same letter will this compromise my position when taking them to court?0 -

This does seem a bit strange, as the OFT have said they will not investage claims under £12.00 in relation tocreditcard charges, what Isugest ( bear in mind my personal thoughts), is contact the OFT and The Financial Obsumbmen, alsodouble check your paperwork, as the court may of assumed that the claim was bank charges, not credit card charges.

Hi.
Bit of a 2 in 1.
If theyve credited you the money to the accounts, theyve reactivated the account, I had this query when I had the bank account with them, it was closed and they put £500.00. to get the money back just go to your branch with your account number, proof of id, take a couple, passport, driving licence, credit car utility bill.
The matter of the money being paid, as long as you accpet it without prejudice, then thats not a prob, its not anything to do with the court sysyem how you get paid before it goes to court, good luck with the claim
