  • I'm in the same situation but awaiting them to make me the first offer...if you look at the Barclaycard Thread there are plenty of people that have issued court action and have got the full amount as i will do...

    It's entirely up to you but if your prepared to take the court action i'd go for the full amount.

    RBS have just offered me £25 of £113 claim, i've just sent them a letter saying that "without Prejudice i accept their £25 offer as a Part-Payment and they have 14 days to repay me the full amount or i will take court action to reclaim it".

    I am no expert but my understanding is:- you issue and the Court gives you a date deemed served which is a few days later. They , the bank/credit co, then have 14 working days to acknowledge. If they do this they then have 14 more working days to say that they are defending My Nat West claim went up to a few hours prior to D day when they put in their defense Then I got a load of stuff from their solictor and an offer in another letter onthe same Most cases have settled prior to a court date.
    However back to your question You should be able to press the judgment button yourseflf Try it . I tried one day and it did not do anything .Then It popped up itself a few days later .The first time -I had not counted 14 working days from date of service. So -- double check date of service , then 14 WORKING DAYS from this date and press judgement

    Hi there,

    I'm going to court tomorrow afternoon (2pm), no news from Barclays, I've been reading the thread for any tips and noticed that when they put the difference between the original charges and the £12 recommended by the OFT in my account, I did not contact them with a letter to say that I either accept or refuse the offer but proceeded to make a court claim at once. I'm just getting stressed that they might use it against me at court? I was thinking of saying that their response did not fulfil the deadline I set in my original letter for them to pay in full within 14 days, I hope it works...

    thanks a lot! getting nervous now..and a bit confused, on the CAG website they suggest I take with me two more copies of my documents (which I can prepare since the hearing is at 2pm), but my question is, do I *really* need to do that? I've already sent them a copy of my bundle to the court and Barclays, should I make more copies again?

    Also, is there a separate thread on here on advice and tips about the court? I've been having a look on the forums but can't find anything so far

    I'm sure your worrying over nothing, they most probably wont turn up, but you must cover yourself so I would take a few more copys just in case.
    Have a look a this over on the CAG site, it refers to Lloyds TSB but its still all to do with the court procedure.

    it's just that the bundle is 85 pages and I already made two copies and sent to them, if I do it again it'll be more money (i'm currently unemployed and on benefits so even this money is important for me!)

    wow 85 pages,
    If you have sent in 2 sets (one for the bank's solicitors, one for the court)
    You should also have a set, is it possible to print on both sides to cut the amount of paper you use?

    well, I'd need to go to a photocopy centre that prints both sides, but still it's a lot and seems pointless - anyway, I'll first call the court some time in the morning to ask if Barclays has faxed any settlement (I hope they have! preparing my argument for the case atm!)

    Im about to start the process with Barclaycard, but i really dont want it to get to the court stage because 1.i cant afford the fee, and 2. i wont turn up.

    The people my IVA is with said they do it for you, should i do that?
