It takes 5 days for the order to be served on them and then the 14 days starts after that....
You should have received some paperwork from MCOL telling you what date they need to acknowledge by.0 -

Thank you for your letter dated <?xml:namespace prefix = st1 ns = "urn:schemas-microsoft-com8th May 2007</st1:date> offering me £xxx as a refund of overcharges that have been added to my account.
I am happy to accept the amount of £ xxx as part payment without prejudice, however I intend to continue reclaiming back all unlawful charges. The original total I asked you for was £ xxx . Taking off the £ xxx offer from yourselves, this now leaves a total of £ xxx which I feel you still owe me.

I have again attached a full schedule of the charges and interest with this document showing the new total now owed to me and I look forward to a full response to this letter within 7 days. If I do not hear from you within this time, I shall commence court proceedings to reclaim back all remaining charges from Barclaycard.

Yours faithfully,No Unapproved or Personal links in signatures please - FT30 -

i sent the letter to barclaycard to apply for my statements on thursday and received the statements today (tuesday) - wow i am amased after the trouble some of you have had, anyway...
i have worked out they owe me £460 but i still have a balance with them of just under £600... i have closed my account with barclaycard about a year ago as i was getting more and more charges and i decided with them i would pay them back at a minimal amount every month.
the question i want to know though is if i accept an offer from them does it have to go onto my old account as like you can see they owe me almost as much as i owe them, so if/when i get some money back from them i want to use it to make an offer to pay the account off, not have the money go into the account so i still owe them an amount as from past experience companys will lower the amount owed if you offer to pay it off in one go
anyone any idea's???
thanks
Hi.
Basically any money that they credit to you in the vormof goodwill gesture orsettlement goes straight to the account, so if you have a credit card withthemit goes there, even if itmeans you have a + balance, they do that.
Good luck with it all, just hang in there, I did got full settlement, interest and court fees back.

Hi all
I had a court claim issued on 16/07 against Barclaycard, it is now 15 days later and they have no submitted an achknowledgement for my claim. Can i now ask for judgement by default or do i have to wait 28days?
Thanks in advance
gavin
In theory you can ask for a judgement, but from experience, esp if you issued the claim with MCOL, barclays have a habit of putting in an acknoledgemnet / defence at the last minute, and you have to allow for the update of the system, so be prepared for a fight. Its happened toa few of us on this forum.xx rip dad... we had our ups and downs but we’re always be family xx0 -
how did you work out the statutory interest ?? outstanding amount 468 + statutory interest = 615
Hi.
Its a bit long winded but it works, the statouty interestis at 8%,
This is the way I work it out.
A = 0.0002 (this figure never changes as it the interset charge per £1.00)
B = Amount of charge
C = number of days
example
£30.00 charge on 31st march 2007, today is 31st July
A=0.0002
B= £30
C= 122
0.0002 x 30 x 122 =0.73p
£30.00 charge interest is 73p
Hope this helps
Cheers

I applied for my charges back from Barclaycard in January and enclosed a £10 cheque. In early April they gave me a Late Payment Refund and I accepted this I didn't challenge for the full amount (although now wishing I had, is it too late?).
I had my bank statement this week and noticed a £10 cheque going out, and guess who to, Barclaycard! They've waited until 6 months later to cash it, probably hoping I won't notice! Am I within my rights to claim this back from them, my original request letter contained the wording "if I discover that you have levied disproportionate penalties against me, then I shall be reclaiming them, and also reclaiming the enclosed £10 Data Protection Act subject access request fee."
