    So should I now send this letter and wait? Or do I send the letter and start the court process straight away? Sorry for all the questions- just bit confused as which step to take!!

    Hi.
    Its one of those devil and the deep blue sea questions, I said no the money and held out for the full lot, but there is nothing to say dont accept the money and go for the court proceedings. if you do keep the money, write and say yes youve had the money in part payment and tha its without prejudice. I would be careful, as a friend of mine is going through this process with LLoydsTSB, they put part payment in to her account and have now refused to pay up any more.

    Def continiue with court proceedings and also contact the financial obsbumen and report barclaycard in reference to their unfair charges, there would of been a leaflet in with one of the letters from the bank.

    Ask any time, its only due to this site that i held out for the full amount, my other claims I settled for the part payment. Us little fish have got to stick together against the big banks.

    So here's the plan. I'm gonna send off a letter reading the following:

    Dear Sir or Madam,

    Re. Account number: XXXX XXXX XXXX XXXX
    I refer to default charges applied to my account amounting to £920 which I have requested you pay back.
    I wrote to you on 18th July 2007, making the original request for a payment in settlement of my claim. After making this request a total of £312 was credited to my account which I am willing to accept without prejudice as a part-payment. I am writing to inform you I intend to claim the full remaining amount of £608 together with court fees in the proceedings through the county court.
    This is based on the Unfair Terms in Consumer Contracts Regulations, as I believe these default charges are unfair and not proportionate to your costs, and therefore the court will rule in my favour.
    I have attached a full schedule of the charges with this document.
    I look forward to a full response to this letter within 14 days, otherwise I will commence court proceedings to reclaim my money.

    AND
    I'm gonna start proceedings with MoneyClaimOnline.

    Does that sound bout right?

    Hi.

    Youve hit the nail, hope you dont mond me saying Id lose the bitwhere you say about from £608,

    Id change that bit to £608 plus interest at 8% and any court costs incurred.

    Pleasew note that this letter was posted on xx/xx/xx as recorded delievery, allowing 3 dasy to reach you, I will allow a futher 14 days for this matter to be settled in full and final, otherwise I will be left with no option to proceed with court action.

    Looks like ALL reclaiming will be put on hold until this test case with the OFT and the Banks is over. :mad:

    Same here, it looks like the claim is in relation to bank account charges, but playing devils advocate credit cards such as Barclaycard are managed by Banks!

    I wrote to Barclaycard to reclaim charges totalling approx £900 (incl interest) The charges without interest were about £600. They have written back saying they disagree with my legal argument (suprise suprise) and are going to credit a paultry £200 to my card - this has been calculated by them as the difference between their previous charge amount (£20) and current charge amount (£12) x total number of charges i received.

    Previously I have been successful with other claims from banks, generally being offered 60% - 75% of my claim and settling for that.

    I am not happy with the £200 offer - I hardly think a £12 charge is a fair amount to charge for a late payment compared to the actual admin costs Barclaycard will incur but I really don't want to have to take it to court which I am going to have to be prepared to do if I decline this offer and give them an amount I will accept (I am thinking about £500 - hardly a kings ransom for them!)

    Has anyone else had any similar experiences with Barclaycard and what was the outcome?

    i had the same claimed 812.00 but without any warning they paid in 218.00!! i calld them as this didnt calculate properly even if they had charged 12.00! they said id have to put it in writing . which i will. also they cancelled my card...
