Ahhh, sounds like a common approach by Barclaycard then. I'll be putting my response in writing asap. Cut my card up a long time ago so if they cancelled the card, so much the better in my view :-)
Must say i am a little worried about how the OFT announcement will affect credit card claims (if at all) but without a crystal ball who know? .....Feb 2015 NSD Challenge 8/12JAN NSD 11/16

Credit CARDS are fair game as Beate has said, there is no change to suing Barclaycard, NatWest Credit Cards, Capital One Cards, etc etc,

I wrote to Barclaycard to reclaim charges totalling approx £900 (incl interest) The charges without interest were about £600. They have written back saying they disagree with my legal argument (suprise suprise) and are going to credit a paultry £200 to my card - this has been calculated by them as the difference between their previous charge amount (£20) and current charge amount (£12) x total number of charges i received.
Previously I have been successful with other claims from banks, generally being offered 60% - 75% of my claim and settling for that.
I am not happy with the £200 offer - I hardly think a £12 charge is a fair amount to charge for a late payment compared to the actual admin costs Barclaycard will incur but I really don't want to have to take it to court which I am going to have to be prepared to do if I decline this offer and give them an amount I will accept (I am thinking about £500 - hardly a kings ransom for them!)
Has anyone else had any similar experiences with Barclaycard and what was the outcome?

I thought I was reading my experience with Barclaycard, they denied the amount, credited the difference between £12 and what they charged, that was credited to my card, without my permission, so I told them I only wanted the full amount and rejected the amount, so they took it back, carried on with court action, we were due to go last wek, guess what, before the hearing, I had a special delievery letter from the litigation department, again denying the allegation, but to avoid court costs etc etc, I had, all my charges, refunded, my court costs and interest at 8%, so I would say hang in there and dont let them win, if you read others on this forum weve all had the same experience and walked away smiling.

Its only about banks, as if everybody recalls, last year, or early this yr, cant remember exactly, but the OFT brought in a ruling to credit crad companies saying that their charges must be proportionate to the costs and that will not investigate any claims when the charge in question is £12.00 or below, so the way credit card companies have took this as its ok to charge people £12, so anybody cliaimng credit card payments should be ok, just need to be 100% sure that any claims or letters we all specify thats its credit card charges.

I received a letter from Barclaycard regarding my claim for £400. They said they would refund the difference between the fees at the time and the current fee of £12, which is £150 in total.
Should I send them a letter to tell them I'm not happy with this or start my MCOL claim?0 -
You need to write to Barclaycard and refuse their offer and tell them you are going to take them to court and give them 14 days to reply IF you haven't already given them the "14 days or I'm off to court" letter.0

My letter sent
" I refer to the charges on my account of £864. I thank you for your prompt response and note your offer of crediting my account with £396
I am willing to accept this without predudice as a part payment only.
I write to inform you that I intend to pursue my claim for the remaining amount of £468
Should I have to commence litigation then I shall also claim this outstanding amount +statutory interest =£615 together with
the Court fees of £120 + Self litigation fees of £230. Thus a total of £965 will be incurred in the County Court
This is based on the Unfair Terms in the Consumer Contracts Regulations as I believe that these costs are unfair and not proportionate to your costs and therefore the Court will rule in my favour
I look forward to your response in 14 days as at this stage I am prepared to accept £468.
If this is not acceptable then I shall commence litigation for the amount of £ 965
Obviously your figures are slightly different but hopes this helps Dont forget to keep copies just in case To show that you have been reasonable and tried to negotiate0
