Hi.
Basically any money that they credit to you in the vormof goodwill gesture orsettlement goes straight to the account, so if you have a credit card withthemit goes there, even if itmeans you have a + balance, they do that.
Good luck with it all, just hang in there, I did got full settlement, interest and court fees back.
Cheryl
even if the account is now closed and has been for over a year???
thanks e0 -

I had my bank statement this week and noticed a £10 cheque going out, and guess who to, Barclaycard! They've waited until 6 months later to cash it, probably hoping I won't notice! Am I within my rights to claim this back from them, my original request letter contained the wording "if I discover that you have levied disproportionate penalties against me, then I shall be reclaiming them, and also reclaiming the enclosed £10 Data Protection Act subject access request fee."
Thanks
Hi.
The cheque. anybody has up to 6 months to cash a cheque in, from my understanding of what you wrote, although you say in your original letter
if I discover that you have levied disproportionate penalties against me, then I shall be reclaiming them, and also reclaiming the enclosed £10 Data Protection Act subject access request fee." you would of had a case, but as you later say you accepted that late payment refund and didnt challenge it, it therefore constitues in law as a contract of acceptance.
Sorry thats not the ideal answer

Hi.
from my understanding of your original post, although you closed the account, there are still payments being made and a sum of money owed to Barclaycard, if this is the case then they like other organisations look after no 1, themselves, so any money recoveredwould then go back to the card holder, if you were left withaplus balance then youwould need to go back to Barclaycard and seeif they will issue you the difference via a cheque.xx rip dad... we had our ups and downs but we’re always be family xx0 -

Hi All
just got a letter of barclaycard after i wrote to try and reclaim charges (£605 without interest, £803 with interest)
they have offered me £209 as a goodwill gesture but state they disagree with my legal analysis.
'i am prepared to credit your account with the difference between the charges that you have incurred and the current £12 fee' ...this brings me to their £209 offer.
They say that if i am not happy i can go to financial ombudsman.
i feel its not a great offer but given the latest statements from the banks, should i take it as i'm better off with £209 than nothing.
dont want to go to court at all but obviously would love more money back. do you think they would be open to negotiation or would they then withdraw the offer.
please help.....i'm v confused :money:0 -
stand your ground.... if the outcome is not satisfactory with the banks oft courts you are gonna see demonstrations like never before... peaceful ofcourse be prepared to march the oft has detatched itself from us the people0

how did you work out the statutory interest ?? outstanding amount 468 + statutory interest = 615
Just put each individual charge through Martin's Interest Calculator with the date and year it was taken and it will work it all out for you. A charge taken in 2001 will incur more interest than a charge taken in 2006.0 -

As the recent OFT case doesn't affect credit cards, go back to them and say you will accept their offer in part payment and without prejudice and will be continuing to court and/or the FO for the remainder.0 -
I am in the process of claiming from Barclaycard.
Taking court action, Barclaycard has defended the claim and I have now received a letter from the court saying:
Before Judge blah blah, sitting at the court....
Upon
IT IS ORDERED THAT
1. Claimant do by 4pm on the 13th August file and serve a schedule setting out each in dispute
2. Defendant do by 4pm on the 27th of August file and serve a schedule setting out how each disputed item is calculated.
Dated 30 July 2007
Can someone tell me what I am supposed to do.....file and serve a schedule??? Need help quick...only have 10 days to file it0 -

It simply means that you have to put into a table every charge that you are disputing although it does not say so best put into a table with date amount and reason for charge. You then have to send it to barclaycard and the court. As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person0
