Hey all,
Been following the steps to claim against Barclaycard, and after 8 days they responded with an offer of £191 against my claim of £625 (with interest).
(They have already refunded this to my card, without my acceptance.)
They said this was the difference between what I'd asked for, and something to do with a £12 fee.
I believe the £12 fee to be a figure set by the OFT as a standard charge for credit limits and such, and I read somewhere on the board that the charge cannot be legally backed up, therefore I can claim for all the charges.
Does anyone have a link to a site/post that mentions this, so that I can quote it in my reply to Barclaycard?
Any templates or advice in responding to an offer like this?

I today received my statements from Barclaycard a full 3 months late!! However the bundle I received did contain all data prior to 2004 aswell, the microfiche stuff.
It's all irrellevant now anyway because I already accepted a settlement from them after complaining through the Financial Ombudsman.
I was paid £540 and after totting up the statements today found out the actual amount charged was £610, so a difference of £70, but it doesn't really bother me cos I've not had any of the hassle of letters, chasing and court claims to deal with!! (unlike my Nationwide claim, bloody nightmare!)
So it seems that they give you a pretty big % settlement if you go through the FO, although you won't know the real figures until they send you your statements several months later!

Thats the stabdrad approach to barclaycard, you can either accept the payment without prejudice and contiue court action, to be onest if you read earlier threads barclaycard pay out before court in full, it happened with me, full charges, interest and court fees, so hang in there. xxx rip dad... we had our ups and downs but we’re always be family xx0 -

Hi Matt.
If you go back a page or 2 theres a post with a letter to accept prejudice.
The just of the £12 is, where the OFT wont investgate any charge below £12, although its not a set figure, its seta precedent so credit card companies are now using the £12 as a base charge.
What theyve credited you is the difference between the original charge and the £12, of course barclaycard are going to say they disagree as they dont want to pay money out, but if you look at other posts hold on in there, fight and your get the money back.

Ive a huge debt with barclaycard being paid off in an IVA. So i just try and get into my internet account to check the charges they have applied over the years, and its locked. I tried ringing them three times and when i type my account number in they tell me there is a fault in the line and to try again later
Looks like ill have to take the lengthy route of mailing them for a list of charges, in which time they will no doubt get a stay like the banks.
Why didnt i start this months ago, i hate being LAZY!! I just know they owe me over £1500.0 -
The waiver doesn't affect credit card charges so you can still proceed with a claim. However be aware than any charges reclaimed will be put towards your debt with Barclaycard, this will of course reduce your debt so all to the good.0

I filed against Barclaycard for myself and a friend. They failed to defend my friends, but have with me.
Sounds like it's still just a matter of time, before i get my doh.0 -
Hi can anyone help, I had a barclay card 4 years ago and closed the account three years ago and in total i had £180 in charges. i wrote to barclays asking for the amount plus interest £240 and have just had a reply saying that the charges are lawful but as a good will jestgure they will give me £72, then in the same post i received a statement from barclaycard and they had opened my account up again and credited it £72, should i just accept it of try for the whole lot?0
