even if the account is now closed and has been for over a year???

    thanks e

    Hi.
if the account is closed, def check thats its been closed fully, and they have not kept the account, open, if the card is definately inactive then you need to put in it writing stating this fact, and asking for any payment to mad direct to yourselves.

    Hi all

I had a court claim issued on 16/07 against Barclaycard, it is now 15 days later and they have no submitted an achknowledgement for my claim. Can i now ask for judgement by default or do i have to wait 28days?

    Thanks in advance

    gavin

What I did was as I got confused with what days things went, so I just went on the MCOL claim every day and attempted to put a claim in, got the replys, too early, then when the date was up barclaycard come in with an acknowledgement, the next stage, was another 14 days for the defence, Barclays submitted, again, I tried every day, but barclays came in with a defence, i had written conformation from MCOL enclosing the defence and saying it had been transferred to my local court.

    hope that helps

    Thanks for that.

A little confused though as I sent full list of charges with claim letters.

Not to worry, will send another copy to both bcard and court.

    Thanks again

basically, although you have sent all the charges, with claim letters, the final schedlue is what you actually claim, remember that your intrest csn be claimed to the court date, if you have had to pay any court fees these needed to be added on, by you sending barclaycard the bundle, you have one as well, as well as the judge, it means you are all working on the same paperwork, you also need a copy of all letters that have gone back and forth, as there classed as court papers.

    Good luck

Im about to start the process with Barclaycard, but i really dont want it to get to the court stage because 1.i cant afford the fee, and 2. i wont turn up.

The people my IVA is with said they do it for you, should i do that?

    Hi.
if its any help re fees, if your on certain benefits, and instead of paying through MCOL, yo fo through to your local court, with the relevant paperwork and they waiver your fees.

As you have an IVA, any money recovered will go straight off that, but in the long run its less money you need to pay back,

    god luck

    Hi there,

I'm going to court tomorrow afternoon (2pm), no news from Barclays, I've been reading the thread for any tips and noticed that when they put the difference between the original charges and the £12 recommended by the OFT in my account, I did not contact them with a letter to say that I either accept or refuse the offer but proceeded to make a court claim at once. I'm just getting stressed that they might use it against me at court? I was thinking of saying that their response did not fulfil the deadline I set in my original letter for them to pay in full within 14 days, I hope it works...

BURNING QUESTION, HOW DID YOU GET ON X:T

Just came back - what a waste of time! I didn't spend more than 1 min in the hearing room because no-one showed up from Barclays, the judge was pretty quick to ask me how much I want to claim back for travel expenses etc. apart from the full amount and the court fees, I answered and he said they'll have to send me the cheque within 14 days or I send the bailiffs - done! :j

But honestly, they have to stop playing these stupid games and either give the money back at once or defend themselves in court properly, I can understand why judges are getting annoyed with them.

Well done, it's always worth turning up ready to argue your case, even if the credit card company can't be bothered.

had a reply off Bcard after first letter saying that they will put £150 into my account as a gg,instead of the £427 that i am claiming. iam going to write back and accept this only as partial payment. and continue with the claim. Is there a template for a partial payment letter. thank you
