    Same thing here - have just drafted letter to say I will accept the £219 as part payment and will accpet the remaining to total my claim without interest - otherwise i will go to court to persue full claim amount... fingers crossed!

  • Another question, i have this morning recieved my statements from old Barclaycard accounts, Visa and Mastercard.

    I have noticed on each of them an "Out Of Order" Charge can anyone tell me what this is and is it reclaimable?

    Interesting to note they also say in their letter that they are not obliged to give out information held on Microfiche....but they have in my case as a "Goodwill Gesture":rotfl:

    Maybe you have been "out of order" and gone over your limit? :rotfl:

    You can claim back late payment fees and overlimit fees!

    I'll pop this into the Barclaycard thread in a minute and you might find the answer there.

    I would definately say it is a 'penalty charge for being Overlimit. It is an old fashioned term.
    Many years ago I went into Nat west to take out money and was refused The elderly cashier very politely , coughed and whispered- 'Your account is out of order ' I looked bemused ' your account is not in order maam'
    Still puzzled and obviuosly thick ( this was because I was sure that wage should have gone in etc.
    'You are overdrawn and have no money' I got the point

    Hi.

    if its any help "out of order" charge, means its another excuse for the institute to charge you more money, could be youve gone over your limit, usually these charges are more expensive, but YES:j they are reclaimable, good luck with the claiming x

  • Well having won against Lloyds and with a Nationwide Claim in at MCOL....i'm now sending off a letter asking Barclaycard for £800...i'll probably get the same stalling letters as everyone else.

    This time i'm going to bring up Litigation fees as Ripski as done...firstly because they wound me up with their letter saying that they didn't have to give me the info off Microfiche it was down to their 'Goodwill'

    Secondly because i'm fed up with the banking industry and all their stalling.

    Thirdly because i'm bored pumping out the same letters and fancy a slightly different challenge :D
  • ok - i am new to this so appologise now if this has been asked before...

    i sent the letter to barclaycard to apply for my statements on thursday and received the statements today (tuesday) - wow i am amased after the trouble some of you have had, anyway...

    i have worked out they owe me £460 but i still have a balance with them of just under £600... i have closed my account with barclaycard about a year ago as i was getting more and more charges and i decided with them i would pay them back at a minimal amount every month.

    the question i want to know though is if i accept an offer from them does it have to go onto my old account as like you can see they owe me almost as much as i owe them, so if/when i get some money back from them i want to use it to make an offer to pay the account off, not have the money go into the account so i still owe them an amount as from past experience companys will lower the amount owed if you offer to pay it off in one go

    anyone any idea's???

    Hi all

    I had a court claim issued on 16/07 against Barclaycard, it is now 15 days later and they have no submitted an achknowledgement for my claim. Can i now ask for judgement by default or do i have to wait 28days?
