They have not yet acknowleged MCOlL will not allow me to enter judgement by default yet (guess as it's the weekend ) is this a common game for BC to play ?

First Direct £1441 paid out £1440
Capital One £816.15 paid £896.15 (inc MCOL costs)
Capital One £662 paid £742 (inc MCOL costs)

it may be that it takes 24 hrs or so for the site to update, what I did was continually check oin MCOL, but Barclays usually come in at the lst minute,they usually acknowledge the complaint, that then gives them an extra 14 days to ssue a defence, which again keeps you ith MCOL, if they issue a defence, then this gets transfered to your local court, if that happens you get a letter from your court saying that have took over the case. If you know that your going to be away in the next 6 mths or there are dates that you can not make, then when you getteh 1st letter from the court write to them and let them know.

To your knowledge have they ever caved in to avoid court appearence.

Hi Dave.
They wetn through all the saga with acknowledgement, defence the transfered to court, they setlled in full with me 4 days before we went to court, that was charges £335.00, interest £95.00 and claim fee was£50.00 with MCOL., they automatically credit the account, I had the credit within 2 days of accepting the money. When I accepted I spoke to the person who offered the settlement, emailed conformation then posted.
99% of the time they settle out of court, as if it went to court the onus is on them to prove exactly how much it costs to process the "letter", and they won't do that.

Just checked and the 14 days I gave them is up , well up not even a letter saying the usual "we believe these charges guff" nothing even close to that just another statement !!! so I think its time for another LBA...Im not really mad...0

After rejecting Barclaycards meagre offer they told me they wouldn't offer anymore and to go to the FO if I wasn't happy - which I did.
Today I received a statement and they have credited the amount to my account anyway!
Do I just let the FO know and let them deal with it?0 -

From here what you do is write to Barclaycard, accepting the part payment without prejudice, ( this coversyou for if it does go to court), but you will contiune with court proceedings if necessary.

No probs at all, as long as you keep a copy for reference thats fine, basically barclaycard like to pass the buck, and if you wrote to the FO, that holds up the court proceedings.
Make sure you keep it to your timetable,

I'm not going via court as I'm in Scotland and the claim limit is low but hoping the FO can sort something out.
