    I might be reading your post wrong, so go 50/50 and try both ways.

    1. Re Moneym the court fees refunded if you are on certain benefits, eg income support, ( the full list will be available on the courts website), then if you apply direct to court and bring the correct documentation, then you wont be charged from the outset.

    2. If you pay upfront say through MCOL or through the court, anytime from when the papers have been processed, then you can apply for your charges back if your on income support etc, not sure how long it would take.

    Hi all

    After being offered £209 against my £803 claim I replied to Barclaycard with a letter accepting the part payment without prejudice and saying I still wanted the full amount, threatening with court if needed.

    I received the following reply:

    "i note that you are dissatsiedf with our offer to refund £209, however, our position remains that we believe it is fair when customers' break the terms of their agreement with us, we recover the costs. Therefore, i am not prepareed to consider your request for any further refund."

    Blah blah, it then goes on to say....

    "If my reply does not m
    Hieet your expectations you may ultimately be eligible to refer to the Financial Ombudsman Service."

    So what do I do now? Is it likely that if i pursue i will get a higher offer or the full amount?? They can't really prove that sending the letters each time you go over limit costs £20-£25 can they????

    What steps do i need to take to refer to the Financial Ombudsman or who or what is MCOL. I havent a clue what to do!!!!

    Also, i still use my barclaycard and have around £600 on it. Can they cancel it and make me repay immediately???

    First thing dont worry,
    Its a standard Barclaycard approach, its the big boy tatics to get you to settle for the money now, more if it goes to court.

    You can contact the financial obsbmen, but its a bit long winded, theres so many complaints going too them,

    MCOL = Money Claim On Line, thats the online version of the courts, once you have gone through all the ways to ask barclaycard for the money, sounds like you have, the MCOL is only for England and Wales.

    Basically your next step is to issue court proceedings, either through MCOL or direct at your local court,

    The way to think of it is, if it does go to court, then Barclaycard have to prove exactly how much it costs to do a letter, and there very unlikely to do that, its like a magicans magic circle you see the results but you dont see how the trick gets done.

    I held out got all my charges, interest and court fees refunded.

    As long as you put that the bit in "that you accept the sum of £xx.xx as part payment without prejudice" and that unless you recieve the difference of xx.xx + interest within 14 days you will have no choice but to proceed with court proceedings.

    be prepared for a letter back saying that they will not give you any more money, then at that stage you will have to decide whether to accept or go to court x

  • I have just received 6 years worth of statements for my Barclaycard Visa and Mastercard accounts.

    This may sound like a daft question:

    How do I determine the charges I need to claim back?

    On some statements it says things like this:
    Late payment charge - £20
    Exceeded limit - £20
    Interest on standard balance 1.456% - £48.58
    Interest on cash balance 1.599% - £23.55

    Are the "interest" payments re-claimable, or do we just add our own interest (using the calculator) when making our claim?

    Overdraft interest isn't reclaimable. You will be allowed to add 8% statutory interest for the amount reclaimed once you file a court claim. See the Reclaim Bank Charges Help Thread for a list of what you can and can't claim.

    have had payment in full from nationwide and cap one now and have today must gone threw money claim online for Barclaycard has anyone won with them since all this new stuff started since ive been away please let me know thanks ive missed this site dont know what to do with meself when i get me money from them have to help others with there claims lol:beer: i am correct in saying that you can still claim credit charges

    As far as i know you can claim charges for credit cards.

    No this test case and the suspension applies only to complaints about unauthorised overdraft charges and the law which applies to them.
    I all have learnt is from others on many sites.
    Seek legal help if unsure.

    Hi fellow claimants , just had a letter of BC offering me a further £152 on the of the £148 the initally offered me . My claim was for £380 , so the are paying in total £304 (dont ask me where the £4 comes from) so I think it will be a yay from me ..good luck and thank you for all the help specially cheryl whos advice came in handy...:beer:
    Do I have to phone to accept or will they just post a cheque ? cos I havent got an account with them now ?
