Hi Everyone, About two and a half months ago i was given back roughly 350.00 Pound from BarclayCard of the total of 950.00 Pound that i was asking for in total charges including interest. They never sent me an agreement letter to ask if i would accept 350.00 they just put it into my account and then told me after. Can i still clam the other 600.00 Pound even though it has been over two months since they can me a partial refund. Can we get all the charges back from BarclayCard? Is the same as Banks or because they have lowered thier charges to 12.00 can we not anymore? Has anyone else managed to get all their charges back from Barclaycard and did you have to take it all the way to the Small Claims Court in order to get it all back?
Can someone please let me know!

In theory the £12 charge is the figure set that the financial bodies etc will not get involved in claiming back, its not set at £12 for financial institues to use, its a guideline amount, so say for example you were charged £30.00 then the big boys would fight your corner for you.
Because they told you after in the letter about refunding you a partial amount that would be the difference between what you were charged and the £12 they now charge.You need to recheck the letter, as by not informing them that you dont want the money, this could be read as youve accepted the payment offered, if this is the case it could make claiming back anymore difficult.
Ihad the same done to me, I refused it andam now on the court route.

Hello,
I have written to Barclaycard asking for my charges back plus interest.
They have replied saying they will allow the charges with the difference between the charge and the £12. Shall I accept or shall I carry on? Can I claim the interest still if I accept their offer?

It's up to you as to whether you want to claim.
If you do claim then you can claim the full amount, not just the difference.
You can't claim the statutory interest unless you go to court and the judge awards it.Hamsters have no tact and diplomacy, nor do they want any.0 -

It is just that on the site it does say that you should consider taking it as they are acknowledging (sp) the charges are high.
I was just wondering if anyone had rejected the offer and were awarded the full amount?

Lots of people have refused initial offers and gone on to win the full amount.

I asked for £100 plus interest and they have offered £400

You can't ask for interest at this stage as you aren't entitled to it yet.
For the low sum you are requesting I'd suggest making your complaint to the Financial Ombudsman rather than the courts. It's free, but the downside is that you have to wait for 8 weeks from your first letter of complaint (unless the bank gives you a final no we are finished with your complaint) before you can go to the FO.Hamsters have no tact and diplomacy, nor do they want any.0 -
When credit card companies levy charges, they have often levied one charge for being unauthorised overdrawn and one for being late with a payment. Does the OFT ruling mean they can still apply both legitimately for £12 each or should the one charge of £12 cover both?0
