  • If you haven't received all the information you require within 40 days of them receiving your Subject Access Request, refer the matter to the Information Commissioner. However, his staff are as inundated with complaints as the banks’ and credit card companies’ are with SAR’s.

Also, the banks and credit card companies have received so many "black marks", that one more doesn't make any difference. Any other firm would have employed extra temporary agency staff to deal with the extra workload, so that they still met their legal obligations.

    Xmas Saver!
    Barclaycard sent me an unsolicited payment of £67 without any letter so I wrote and i said that i accept it without prejudice because they directly credited me without my permission. I asked for the rest back (£430) and recived a nasty letter today basically telling me to naff off.

    I began the mcol process to reclaim the rest. Anyone else in this boat? Any advice or tips? Will they get stroppy??? Thanks in advance folks!

    Barclaycard are an absolute pain, :rolleyes: Ive been through MCOL with them, they always come in at the last minute, with an extension, which gives them another 14 days, then they put in a defence at the last minute, which means it then gets passed to your local court.
    Im playing the waiting game, got a hearing in July.
    Good luck and be prepared for a long drawn out fight

    hello they have done all of the above to me, waiting for a court date, do they go all the way to court? or do they back out before?:mad: :think: has any body actually gone to court? my card is sky card.they did offer me a goodwill payment but i refused thanks:money:

    I actually inserted the following paragraph in my SAR letter:

    "I am aware that Barclaycard have previously refused to supply certain data on the grounds that records prior to May 2004 are not stored on a 'relevant filing system' as defined by the Act. I am also aware that the Information Commisioner has upheld complaints by Data Subjects regarding this issue and concluded that Barclaycard's microfiche files are indeed a relevant filing system. For this reason I will not accept any refusal to supply the requested data and I shall treat any such refusal as a contravention of the Data Protection Act."

    Hopefully this will push things on a bit! :cheesy:

    Barclaycard have always proved difficult with SAR requests, try using similar wording to the above post by UNDERGROUND and have a read of this thread for more...

    Hi all just a quick question, I sent for my statements from Barclaycard and recieved them within 10 days .It is an account I closed in 2005 and they sent me them and didnt cash the cheque. Now do I use the same letter as the bank charges letter or is there a different type to send ?

    p.s Ive totted up the late fees/over limit fees ,now can you add the interest or do cards work different from bank accounts ?

    Hi.
    Bear in mind that anybody has upto 6 months to cash a cheque, so they may do it at a later date.
    Yep, you use the same letter for bank charges, just alter the account numbers etc.
    Interest is 8% for all claims, Ive got a formula set up on the other computer, will post it on to this board, later on, bit long winded but means you can do the interest yourself.

    Good luck with the claims.

    HSBC: £4456 outstanding
    Barclays: £1246 outstanding

    HSBC GoldCard Settled £20
    Barclaycard Settled £132
    Platform Mortagage Refund £30



    First time poster. Didn't think there was much point until I had a real problem!!

    Grateful for any assistance in this. Sorry it's so long but please stick with it.

    I am happy to say that on the 8th of June I received a letter awarding £132 from Barclaycard for charges on my closed credit card account. I was pleased with this. The letter told me to ring a Mark Birchall on 0161 200 7274 to give them my bank details.

    I did so on Tuesday 5th June. This number turned out to be wrong and I was sent about the houses for 20 minutes but was then put a bloke with a Manchester/Bolton accent called Kay. He took my details and then I moaned about my other bank charge cases against HSBC (£4456 owed) and Barclays (£1246 owed).

    He then very kindly gave me advice to keep pushing for the full amount but I said I wanted to offer Barclays a settlement of £1000 if they accepted by Friday as I am getting married shortly. He said that his office were dealing with the paperwork for the Barclays claim and he said it was with the Litigation Department and he would see what he could do.

    He rang me back 10 minutes later and said that Litigation Department would action it straight away and that a letter would be with me by Friday 8th June. He gave me his number I thanked him (regrettably saying that if I was in Manchester I'd buy him a pint) and sat back waiting for my letter and bought a couple of things for my wedding and paid extra into my bills which I shouldn't have really done but I genuinely thought the money was on its way.

    Anyway on Friday I rang Kays direct line (a number which unfortunately I can't post as it has gone missing). There was no answer. I have not been able to get through to him since.

    I then phoned Barclays who told me they had no record of this agreement. The Customer Service Team put me through to a Mr Tom Hickey who is the lawyer dealing with my case. Mr Hickey told me that only he had the jurisdiction to award me with any charges. He is now dealing with my complaint but waiting on other departments to get my account records. He has been helpful but this whole thing has left me struggling to pay for my mortgage and leaving me to consider calling the whole thing off.

    Subsequently Barclaycard haven't got back to me and are not even taking my complaint seriously. The complaint I logged on Friday wasn't even entered into the system.

    I've been threatening the FSA,Lawyers and Press. Am I being overdramatic which is what I was called earlier on the phone? This is driving me up the wall and causing me unbelievable angst and stress. I need advice please!!!!!!!

    To add to that HSBCs first offer which I received on Thursday 11th June (£2700) was an insult as it was not even all I'd been deprived of so I refused them thinking my Barclays refund was coming but now I wish I had taken them up on it.

    To Martin ill be writing to Her Maj as soon as this mess is over. :T :T :T

    :confused: Hi all claiming back some charges on my barclaycard account (about £150) went though the MCOL process and they have just put in a defence:sad: . They sent me a letter a while back crediting my 'closed' account with a good will gesture, so i rang the bank and refused the offer and told them i had no access to the money as the account was closed 6 months ago. I have'nt accepted the money so can i still claim the full amount, any advice
