I applied to Barclaycard for statements for me & my wife like almost everyone here. My account was closed years ago so I'm spoiling for a fight as I have plenty of time.
My wife got the standard letter saying they'll give her statements from after 2004 & it may take up to 6 weeks for the rest. They also sent back our cheque of £20 for both of us as they couldn't find my account.
I think that I'm in a good position in the sense that Barclaycard sent me back my original letter with a 'Received' stamp & date on it so I'll send them a follow up letter for my wife & then on to the IC as I expect to happen.
I thought that it might be a good idea to apply to Experian & Equifax for my details going back 6 years. I might be able to find out my account number from there. Has anyone tried this? How successful were you?
I understand that it can be mildly irritating if I ask a question that has already been answered but I've painstakingly checked the whole of the Barclaycard board and not found any answers to this. Could someone point out to me any of the following -
1) Has anyone taken Barclaycard to court AND WON?
2) Did anyone get their microfiche information without being charged extra?
3) Has anyone been able to find a way to get Barclaycard to tell them their account number? I gave them my full name, present & previous addresses and my date of birth but no joy!

Firstly good luck in all this, Im in the process of court action with Barclaycard, got a case conference in July,
your q2, I can help with that one, as I got the microfiche without any extra charges, basically the argument you use if that you never asked for statements that you meerly asked for a list of charges that had been applied to your account, if they wish to provide copy statements then that is up to them, and is more than your original request.
As for checking back, id stick with Experian, there the most popular choice, as otherwise your end up paying twice for the same info.

anyone know how long it takes for BC to send out the microfiche stuff? i have been sent the statements after 2004 but need the rest. can i still send a complaint to the imformation commissioner if they still take longer than 40 days and they've sent me some of the statements even though i ve asked for more?Scrimping and saving!0

Barclaycard are being slow with the microfliche, if you havent recieved ir after 40 days, report it to the information comminiser, would also worth putting a report in2 the financial obsbumdman (excuse spelling), I got them invoved when I had the probs getting the info from them/

Barclaycard sent me an unsolicited payment of £67 without any letter so I wrote and i said that i accept it without prejudice because they directly credited me without my permission. I asked for the rest back (£430) and recived a nasty letter today basically telling me to naff off.

I have written to my bank and credit cards asking for statements going back six years [as per your letter]. I have had statements from a credit card company from June 2004 to April 2007 and they have said that the other statements are on microfilm and they will send me copies but this could take upto 6 weeks.
Is this acceptable , if not what could I do as this 6 weeks would take me over the 40 days.0 -
If you haven't received all the information you require within 40 days of them receiving your Subject Access Request, refer the matter to the Information Commissioner. However, his staff are as inundated with complaints as the banks’ and credit card companies’ are with SAR’s.The acquisition of wealth is no longer the driving force in my life.0

That sounds like BarclayCard! Sent off the first standars letter - First they replied sending the cheque back saying I'd not made it payable correctly(which I had!), then when I wrote a covering letter with ANOTHER £10 cheque with the SAME 'PERSONS' PAYABLE they accepted the cheque and sent back a letter saying sorry but "..the information we have enclosed relating to this account is all we hold" -- It only goes back 3 years??
Please help!

Also, the banks and credit card companies have received so many "black marks", that one more doesn't make any difference. Any other firm would have employed extra temporary agency staff to deal with the extra workload, so that they still met their legal obligations.
In the meantime, you can always draft your first claim letter so that, when your data does arrive and you've done your sums, you just have to fill in the blanks.

Just starting my claim on barclaycard now and have sent for S.A.R - (Subject Access Request) - this I was told would take 40 days as they were inundated. they said it should be resolved by june 8th. Yesterday - june 7th they arrived - well not all.
this was inthe letter:
' Enclosed you will find copies of your credit card statements from june 2004 to the present time. These statements are stored on computer. We will be sending your statements prior to this date later. These later statements are stored on microfilm (rather than computer) and,take more time to search and reproduce. We will get this information to you as soon as we can. This is likely to be within the next 6 weeks or so.
Statement requests are being processed in the order in which they have been received to seek to ensure fairness. The Data Protection regulator,the Information Commissioner,has been made aware of the position and knows that we are writing to you in these ternms. The information Commissioner is also aware that whilst we are endeavouring to supply this information as quickly as we can,we do not consider that the microfilm statements fall within the scope of the Data protection Act 1998. Nevertheless,we are happy to provide these as a gesture of goodwill.'

So Ive already waited 40 days now I have to wait another 6 weeks or more? can they do this?. The statements they have sent me already have around £700 on them in charges. Any advice on what I can do next?0
