Hiya, I would keep at it. I had the same thing with Barclaycard and I wrote back. I got the full amount after the letter. Here is what I sent - basic but it worked:
Dear
Thank you for your letter of (insert date). You will be aware that the amount of charges I was claiming is £insert amount. In your letter you are offering me a total of £insert amount. I accept this refund without prejudice as partial settlement of my claim.
However I must inform you that it is my intention to proceed with court action in order to receive a refund of the full amount of £insert amount plus interest at the rate of 8%.
I intend to proceed with court action on (insert a date, I gave them 14 days) However in order to avoid this I am happy to accept a full refund of these charges
I look forward to hearing from you.

Thanks for your advice, I will send the 2nd letter in tomorrows post. Also my CapitalOne statements arrived today also, so their 1st letter will be sent out also.

I sent my SAR request (one of Martin's template letters) and £10 on 8th August. Recieved this reply, and the details I requested today:Dear Mr Oxley

DATA PROTECTION ACT 1998 - Subject Access Request
Further to your recent request for personal information held by Barclaycard, please find enclosed a copy of the card statements you have requested.
Statements held prior to May 2004 are stored on microfilm which is a means of storage that does not fall within the definition of "relevant filing system" under the Data Protection Act 1998 ("the Act") nor within the bounds of what we are obliged to provide in responce to your data subject access request as set out on the Information Commissioner's Office website at www.ico.gov.uk
The Information Commissioner has indicated his intention to amend this guidance. It is therefore as a gesture of goodwill to you, our customer, and in light of this proposed change that we enclose copies of our pre May 2004 statements as you requested although we take a different view to the Information Commissioner's Office on whether these fall within the definition of "relevant filing sytem" as set out in the Act.
This is regarding an account I had from July 2004 - September 2006.

I can't believe that nearly 2 years after the IO ruled on this, Barclays are still begrudgingly complying as a 'gesture of goodwill'

I don't know if anyone could help me but I started to reclaiming charges back from Barclaycard.
Total charges came to £364 plus £95.24 interest.
I have just looked at my account online and even though I haven't received a letter from them yet they have credited my account with £112 and £8.96 interest (been the difference between the £20 and £12 charges).
I would like to try and receive the full amount if possible but does anyone have a template letter basically telling them you accept this as a partal offer and asking for the remainder.

Dont have a letter like, but just shows how sly the banks are I think. I heard if you spend any of the partial refund they can class it as you have accepted this as final payment (Dont know hoe true that is tho!). I would just ring or write to them and say that you will only accept the full amount, if not you will take them to court!.0

Hi Barclays did the same to me but I did get a letter. I wrote back saying something along the lines of what I have put below. Once they got that letter they wrote back very quickly and gave me the full refund.
Thank you for your refund of x pounds which I accept without prejudice as part settlement of my claim for x number of pounds.
However I must inform you that it is my intention to proceed with court proceedings should I not receive the remainder of my requested refund within 14 days.
I intend to instigate court proceedings on such and such a date.
However, in order to avoid this action I would be happy to accept a full refund of the charges I have paid.

Can someone clear this up for me? I know credit card companies dropped the charge form £20 to £12 but when i put in a letter to Cap 1 i included the £12 charges aswell! Has anyone had a full refund including the £12 charges???0
