    I wrote to BCard asking for charges to be refunded. I have several from 2004/5 at £20, and several after April 2007 at £12.

    The charges total £328, with interest at £49 - I've asked them for the full amount back = £377 (all the charges plus interest, not just the charges above £12).

    They wrote to me today offering me £40(!) - basically the difference between the £20 charges I've listed and the £12 'now-standard' charge cost.

    Should I go full steam ahead for the full amount, or should I just take their measly £40 offer and accept that I won't get the £12 charges back?

    What do you think? I'm not sure how to proceed. :confused: I've got nothing to lose, no balance on the card, so no fear they will try to forclose on my account.

    What are my chances?

    I think you should proceed with the claim. Most people find their banks offer them silly amounts at first then pay in full once they continue their claim.

    Haven't the £12 charges been agreed as legal though and therefore aren't recoverable like the previous higher charges?
  • 1. I helped a friend with Barclaycard and can tell you that for 2004/5 charges their first letter is offering the "difference" figure and you just have to write back threatening legal action and they increase the offer to the full £20. Double check the interest using Martin's spreadsheet though. They claimed it included 8% interest but they calculated it too low. Accidentally I'm sure.

    2. As for the £12 being "legal". This has been mentioned lots of times on this site. It's not legal as such, it's just that the OFT have stated they won't automatically launch investigations to charges as "low" as £12. They reckon this is the level where charges might be fair - but they still might still be unfair! Credit card companies don't want to risk having to justify a £12 figure in court because, let's face it, it's probably still too high. That's why they usually give in eventually even over the £12 fees.

    Is offering to accept £200 as final settlement enough? Or shoudl I go for £250?
  • Hi there,

    I'm new to this - So, hello!

    Basically, I'm claiming over £1100 worth of charges from Barclaycard dating back over six years. I've gone through the step by step guide as advised on this site. There is around £400 owing on this card by me. The first reply from Barclaycard came back to me saying they pay this back to me to clear the account. But I refused this and decided to go ahead and claim the full £1172.00. However, I wet through the process on moneyclaim olnine and now I have something come back from the court saying that:
    '1.Following the filing of a defence or holding defence the claim shall be stayed in the Office of Fair Trading test case.
    2. Liberty to apply with a explanation.'

    Then it goes onto say that 'A party affected by this order may under rule 3.3(5) apply to have it set aside varied or stayed within 7 days of service of this order.'

    My first question is: What does this mean? Can I appeal? Also, I thought the the office of fair trading decision was for bank account charges, not Credit Cards?!

    Also, it says I have seven days to apply (Which is up tomorrow!)

    Advice please?

    Ok Iv got a barclaycard and know i def have money to claim but I'm scared that if I do they'll close my account which right now I really need as I'm using it as a way to build up my credit score through paying bills with the card and then paying these off keeping my payments on time everytime.

    Can anyone offer some advice please?
