Once_bitten - yes the card was cancelled with money still oweing on it, but she just pays her monthly minimum amount as per normal, but the only difference is they have taken away credit from her account. She she still gets monthly interest etc.
I'm guessing she can still claim her charges back then?? :cool:0 -
You can always make a claim if the account has been closed, they will have her details on file somewhere.Barclaycard - £1251 reclaimed

i was released from my bankrupthy last year and i have since been persuing getting my crdit card charges back, i have been succesful until i asked barclaycard for the back, they were about to pay up until they realised i was bankrupt and said they wold put the money towards paying of the debt. i argued that as a realeased bankrupt the debt didnt actually exist any more and i was not liable for it. they have sent a final respaonse and wont seem to back down, any one can help ?.0

So they have already had the loss when you went bankrupt and now you want them to stump up again. This may be legal but it is taking the micky a bit I would suggest.0 -

I had a debt with Barclaycard of £1100, which they eventually sold to 1st Credit (my final statement from Barclaycard said they only sold it for £350). I have since settled the full amount of £1100 with 1st credit. I am trying to claim approx £900 worth of charges from Barclaycard.
Will I be able to claim it all back in full or will they only give me a % based on them making a loss when they sold the debt? How hard can I push for all my money? Do you know what my rights are, after all I never asked them to sell my debt on for next to nothing.0 -

You are entitled to ALL of it back.
Had you not been overcharged in bank fees, you may not have ended up in that mess.
Follow the procedures as per normal. What happened to the debt, is not your problem.
If you receieved a default on your credit report as a result, you may also want to argue for its removal, saying it was caused by charges on the account.0 -
Hey guys,
So far i've sent two letters to Barclaycard, one asking for my statements, and the other asking for my over charges plus vat.
I sent the normal templated letter adding 8% vat on all charged dates that totalled to the sum of £273
The letter I received today stated that they felt their charges were fair and are outlined on each statement etc etc....
They went onto saying.
"Putting the above to one side, as a goodwill gesture and without and admission or liability, I am prepared to credit your account with the difference between charges that you have incurred and the current £12.00 fee. This would total up to £67.00. This credit will be reflected on your next statement."
Well obviously a templated letter they send to everyone as i no longer receive statements as the debt was shifted onto a DCA.
what shall I do? Send the next letter asking again for the full amount and threaten court proceedings....or take the goodwill gesture payment?
Any advise is much appreciated.
Oh also one more thing, the £235 in charges without my interest with their interest added upto well over £600. So i think asking for £273 is pretty fair!!0 -
I guess i've got nothing to loose in proceeding to the next step. I'm not really desperate for the £67 as any monies repaid are used to lower my limit.
