    I was under the impression that it is only if your case goes to court that interest can be awarded.

    Depends on the CC company - MBNA give compound contract interest after the second letter.
    No Longer works for MBNA as of August 2010 - redundancy money will be nice though.

    Hi, after a lot of reading through success stories on this forum, I recently decided to re-claim my BarclayCard charges on 19th May. I sent off the £10 for statements, and today got them through the post.

    I've totalled up all the charges, and calculated interest etc but I'm not sure of one thing - On each month I have been charged 2 amounts of £20. One for late payment, and the other for either exceeding credit limit, or over credit limit charge.

    Now, the late payment fee may have pushed me over the credit limit, so to me this seems that it's the same charge. I am planning to claim the difference between the £12 recommended charge and the actual amount they charged me (plus interest on each) So, if in one month they charged me a total of £40 (for late payment and over credit limit charge) could I reasonably argue that they should've only charge me £12 for the whole month charge, and reclaim £28 for that month + interest?

    I realise the whole claiming process is an art of sorts, and it's really up to me what I decide to request, but I want to stand the best chance of an easy re-claim withiout too much hassle, which is why I'm not asking for the whole amount plus interest.

    Anyone got any ideas?

  • I have a few ideas. When was the £12 made legal? It is the threshold that was set by the OFT as a marker that they would not take action under. It is not legally binding. You can claim the £20 charges and can chose to accept the difference plus interest that BCard may offer.

    The best thing to do is to read the guide that Martin Lewis has made and fully understand the process because SHOULD it come to court you need to know what you are doing and why the breech is unlawful(NOT illegal).

    Take your time and they will more than likely offer the difference between £20 and £12 OFT threshold.

  • if this at all helps, I had my reply back from barclaycard last week, (it took less than 2 weeks to sort) I had all my statements on file, so running through them I had 2 seperate incidents where i have been charged £12 twice for each missed payment, and then interest at the end of each month. i used Martins template and Barclaycard have refunded 4 * £12 charges with interest. (does that make sense?)

    However Tesco mastercard have refused !

    I think you have a fair chance of getting anything over £12 back, and they may actually refund the £12 too.

    i have no experience of barclaycard but tesco visa paid up as soon as the process reached mcol, as did MBNA credit card and capital one credit card. HSBC gold visa was the exception and paid up in full (without interest) after the first letter asking for refund.

    Thanks for your help guys! After much thought, I decided to just go for the whole lot, including interest - What's the worst that could happen, eh?
    So, instead of counting the two charges each month as one, and taking off £12 from that, I'm just asking for everything back.

    I'll post my success story on the boards when it happens ('when' - not if!)

    Hello everybody,

    Does anybody know if Barclaycard will refund charges when they have cancelled your account and stopped your credit?

    A friend has a Barclaycard debt but her card has been stopped due to non payments, so she's thinking about chasing Barclaycard for charges but doesn't want to bother if she's unable to due to her account being terminated.

    She already has all her statements, and has been charged £660 in charges up until August 06 in Late payment charges, exceeded limit charges and returned cheque charges. After 2006 the charges drop to £12, does anybody know the date you can claim up to? didn't charges become legal sometime last year?

    Also, what charges can she claim? and how do you work out the interest?

    Also, does this affect her Barclays current account?

    Sorry for all the questions. I've had a look thru all posts but can't find the answers. If there is a thread with the answers on can somebody please post it for silly me. :D

    You can always make a claim if the account has been closed, they will have her details on file somewhere. All she has to do is write to Barclaycard and ask for the charges to be refunded. If she has all the statements for the last 6 years then she just has to total up the charges, and decide which she wants to reclaim.

    Its really up to her what she wants to reclaim, and there is no date beyond which no claim can be made. The OFT agreed that any charge over £12 was unlawful, but this does not mean to say that the £12 fee is legal, and cannot be claimed. Its entirely up to her if she wants to try putting claim in for all or some of the charges she incurred.

    Martin and his team have kindly put up a whole section on credit card claiming on this site to guide you through every step of the process. There is even a charges calculator where you can enter each charge, and charge interest on each of you wish. This can be used to back up your case when asking for money back (you can print it out)

    It will not affect her Barclays current account at all, its completely separate!

    If the credit card account is closed she really has got nothing to lose in trying to claim all charges + interest in my opinion. That's certainly what I have done with Barclaycard. She will have to decide whether or not to accept their first offer, or try to push for the total amount thats all.

    Was your friend's card cancelled with money still owing? I may be wrong but I would have thought any claims would have gone to paying off the non-charge related debt
