  • I had a letter to say they were dealing with this case but to allow up to 4-6 weeks.

    I have phoned them chasing them on several occasions but apparently this has been passed to some department that takes no calls and any contact is via memo or letter only - to which I have to wait for 4-6 weeks for any response!

    Frustrating.

    I've also read some interesting things about the warrant of execution and that if the Bailff at a cost of £55 per time cannot execute the warrent after 5 attempts then it is returned, if he is asked to leave and cannot gain peciable entry, again he will fail and there isn't anything an individual can do about it.

    Any ideas?

    I sent a letter to capital One last week. This account was closed a year ago so I didn't think I could claim but after reading other posts on this site, I've decided to give it a try

    As I already have statements for the last six years, I just added them all up - I sent a letter requesting the full refund and they have two weeks before I start court action.. I'll send a LBA letter next week before starting the court bit.
    Does anyone know how long it takes before a refund.. do they pay out before court action or just before the court date?

    Thanks Beckie :D My claim was served on Cap One on 22 May, and their letter offering to refund charges, interest and court fees was dated 12 June :T A lot of people here have found that Cap One offer to settle up the full amount around 21 days after being served with a claim. I'll bet the same happens to you - keep me posted!

    Hey everyone

    I am claiming about £2500 for OH through Capital One at the moment. Have received no reply from 1st letter so have prepared 2nd letter to send, giving them 14 days, before I go to Court. Is it worth OH giving them a ring first to see if he gets somewhere before sending the next letter? :confused:

    If so, what telephone number is it?

    And if I have to send 2nd letter, is it best to send to registered address or local branch?

    Update. OH rang Capital One tonight who said they had sent him a letter offering him £700 :rolleyes: . He has never received it. He told them he was not accepting the offer. To which they said, carry on sending us your letters then. :rolleyes:

    So I assume next step is send them the letter threatening Court Action if no response within 14 days? :confused:

    No point tbh they wont pay,just start court proceedings,or you'll waste 14 days.

    We wouldn't want to disappoint them, so send them the second “Letter Before Action” letter. At this point, you have to decide between referring your claim to the Financial Ombudsman or starting court proceedings.

    If you don't think that you could successfully handle a court claim, or can't afford the court fees and aren't eligible for fee relief, then the Financial Ombudsman is an alternative. It is free of charge and handles everything for you. However, they cannot force the bank to pay up, set the level of the settlement or award interest like a court. Despite this, their success rate is good. Being financial experts, they can also threaten to ask the bank some very awkward questions. If the Financial Ombudsman is unsuccessful, you can still take the bank to court.

    If you threaten to refer your claim to the Financial Ombudsman, give them until 8 weeks from the date of your first letter to reply. However, if the reply either suggests that you now refer your claim to the Financial Ombudsman or says a definite no, then you can refer your claim to the Financial Ombudsman straight away. If you have not received any reply for the 8 weeks, then you can refer your claim to the Financial Ombudsman.

    If you threaten to start court proceedings, give them 14 days to reply. If you have not received an acceptable reply by this deadline, then start court proceedings on Money Claim Online.

    After successfully claiming back my bank charges from natwest i decided to start claims for my credit card charges however this is not going to plan! I have had really stupid offers sent to me nothing like the amount they owe me so by the looks of this thread it seems that they are only paying up once you make a claim through MCOL. The thing is i cant really afford to do this for all 3 cards.

    I have wrote my LBA and gave them 14 days which is now up. I suppose the only thing i can do now is wait till i can afford MCOL but its so annoying when they owe this money to you and you have to go and spend money you havent got claiming it back! :mad:

    Sorry just a little rant im so annoyed today!

    Just an update - Capital One paid up in full today - charges, interest and court fees, AND sent me the cheque as requested, instead of refunding it to my credit card. Yahoo :T :T

    Congratulations! :j I didnt know you could ask for a refund by cheque did you have to state this in your letters before you filed on MCOL?
